본 논문은 현대의 윤리적 문제점으로 제기되고 있는 인간 복제 문제를 칸트의 윤리학적 관점에서 검토한다. 특히 칸트의 주요 개념인 인간 생명의 존엄성, 선의지와 의무감 그리고 수단-목적의 근거에서 그러한 문제를 규범적으로 통제할 수 있는 보편적 판단이 가능한지가 글의 중심 주제이다. 이러한 검토의 일차적 결론은 윤리적 판단의 선험적 근거의 정초를 목표로 하는 칸트의 관점에서는 이 문제에 대해 규범적 판단을 내릴 수 없다는 것이다. 구체적인 행위에 대한 규범적 판단은 경험적, 사회적인 사실에 대한 배려를 전제하며, 윤리적 판단을 행위의 결과에 근거시키는 공리주의적인 사고에 의해 가능하다는 것이다. 그러나 이러한 사실이 칸트적인 윤리학적 사고의 무용하다거나 공리주의적 사고가 유일한 방안이라는 것을 의미하는 것은 아니다. 공리주의의 물질 지향적 계산주의나 과학적 예측력과 문제해결 능력에 대한 낙관적 태도는 경계해야할 것이다. 다른 한편 칸트적인 의무의 윤리론은 행위를 도덕적으로 정의하기 위한 지향적이며 통제적인 의미를 가지며, 사회적인 공적 규범 설정에서 필수적인 전제로 요청되며, 공리주의적인 사고를 보완하는 역할을 하는 것이다.

This paper examines the ethics of human cloning from a Kantian perspective. The main concern is whether it is possibile to deduce general ethical judgements regarding human cloning on the basis of the Kantian concepts of human dignity, goodwill, duty and means-end. The principal conclusion is that this is not possible because of Kantian methodology, which merely explicates the transcendental basis of ethical judgements. Such judgements need to be supplemented by empirical and social facts, and to make ethical judgements on the basis of empirical facts is a form of utilitarianism. This, however, is not to say that Kantian ethical theory is useless or that utilitarianism is unproblematic. Matierialistic and instrumental thought is not entirely relaible. On the other hand, the Kantian ethic of duty has a valuable regulative function, leading to ethical behaviour and providing the basis for the construction of social rules.
