성매매의 합법화를 둘러싼 논란을 의미 있게 풀어내기 위해 전제되어야 할 작업은 성매매 자체의 윤리성에 대한 철학적 평가다. 본 논문은 이런 평가 작업을 두 가지 문제의식을 중심으로 수행하였다. 우선 매춘 문제의 해결은 무엇보다도 매춘 여성들에게 덧씌워진 부당한 윤리적 낙인을 벗겨내는 데에서 출발해야 한다는 점이며, 또 하나는 성매매의 범죄화와 불법화에 동원된 기존의 윤리적 논거들이 설득력과 정당성을 충분히 확보하지 못하였다는 점이다. 먼저 성매매의 비윤리성과 관련하여 제기되는 논변들 가운데 상당수는 여성혐오주의적 논변에 입각하고 있다. 그리고 이런 논변의 직접적이고 일차적 피해자인 매춘 여성들은 이로 인한 윤리적 낙인 때문에 최소한의 기본적 권리에서조차 배제되어 있다. 다음으로 성매매의 불법화를 위해 즐겨 동원되는 논거들인 낭만적 애정관, 성적 서비스의 상품화 문제, 인권 문제, 소외론 역시 개인 윤리의 차원에서나 성매매의 현실 논리란 차원에서는 의미 있는 문제 제기일 수 있으나 국가가 성매매를 불법화해야 할 윤리적 논거로 기능하기에는 충분하지 않다. 마지막으로 성매매와 여성 종속을 연관시키는 논거는 그 자체 분명 설득력이 있으나 문제는 이것이 성매매의 불법화를 위한 윤리적 논거로 작용하기에는 타당성이 떨어진다는 점이다. 이런 논의 과정을 거쳐 성매매의 합법화의 필요성과 의미를 따져보고, 성매매의 합법화가 여성 억압과 인권의 문제를 해결하는 지점과 어떻게 연결과 수 있는지 점검할 것이다.
A meaningful debate about the legalization of prostitution presupposes the philosophical reflection of the morality of taking money for bodily services. In this essay I take this task with two starting points. First of all, we should begin from taking off the stigama attached to prostitutes to solve the problem of prostitution. Secondly, the ethical grounds and beliefs supporting the criminaization of prostitution are mostly not rationally defensible. Most arguments for its criminalization are based on misogyny, which justifies exclusion of many prostitutes from enjoying fundamental and basic human rights. Some of arguments for its criminalization such as "romantic love", "sex as commodity", "human rights", "alienation" don`t succeed in justifying its criminalization, though they are worthy of being respected as a personal conception of good or logic of prostitution being practiced actually. The feminist argument that prostitution perpetuates male dominance of women by selling the image and identity of subordinated women is itself very serious and cogent, but it doesn`t explain why only prostitution must be criminalized of other jobs and practices that are oppressive to women. Finally I examine the need and the meaning of the legalization of prostitution and consider if it can contribute to help rectifying the oppression of women and improning the situation of poor women being excluded from enjoying human rights.
