본 논문은 다수의 미국 메트로폴리탄 지역에서 적용되고 있는 development impact fees 부과에 다른 주요 사회경제 윤리적, 법적 논쟁들을 고찰하였다. 급속히 성장하고 있는 메트로폴리탄 지역 외곽에서의 새로운 도시 하부 시설과 공공재를 생산하기 위해, 미국내 많은 지방 정부들은 점점 더 development impact fees에의존하게 되었다. 하지만, 이러한 도시 신 개발을 위해 부과하는 development impact fees는 새로이 조성된 커뮤니티의 사회적 배제성 효과를 포함한, 도시 공간 창출과 신 개발에 따른 여러가지 심각한 사회경제적 윤리성에 관한 논쟁을 초래하였다. development impact fee 부과가 공간에 미치는 영향 중 하나는 바로 development impact fee가 membership fee로 작용할 가능성이 높아지게 되어 로컬리티들간의 사회경제적 불균등 발전을 창출하거나 심화시킨다는 것이다. development impact fees의 부과와 사용이 고의적이던 비고의적이던 간에 특정 사회 그룹들을 배제시킬 소지가 크다. 이러한 점에서 도시계획상의 기존의 zoning 시스템과 최근의 development impact fee 시스템은 둘다 사회적 배제성 효과를 지니고 있는 점이 공통점이다. 신 개발과 도시 성장으로 인해 누가 혜택을 받는가라는 사회적 질문과 함께, 더 나아가 신 개발과 도시 성장으로 인해 누가 혜택을 받아야 하는가라는 사회경제적 윤리성에 관한 질문은 중요하다. 이러한 질문들은 궁극적으로사회적 정의 개념과도 밀접한 관련이 있다. 급속히 성장하고 있는 몇몇의 미국 메트로폴리탄 지역 외곽에서의 신 도시 공간 생산, development impact fees, 사회경제적형평성, 그리고 사회경제적 윤리성에 관한 논쟁들은 한국의 도시 개발과 성장의 맥락내에서 재해석되어 질 수 있으며, 더 나아가 함의하는 바가 클 것이다.

This paper examines the main ethical and legal issues on the imposition of development impact fees adopted in many US metropolitan areas. In the United States, many local governments have increasingly relied on development impact fees for the production of new infrastructures and public facilities at the fringe of booming metropolitan areas. However, the increasing reliance on the use of development impact fees on new development raises serious ethical issues including the effects of development impact fees in increasing the exclusivity of communities. One of the spatial consequences of development impact fee use is that impact fees may be used as a sort of membership fee, thus creating or intensifying the spatial pattern of socioeconomic inequalities among localities. It is highly likely that development impact fees can be used to-both intentionally and unintentionally-exclude certain social groups. There are similarities between zoning and development impact fees in that both have exclusivity effects. In addition to who does benefit from new development, another important question is who should benefit from new development. These questions are ultimately intertwined with the concept of social justice. The ongoing ethical debates on the production of new urban space at the edge of many booming US metropolitan areas, development impact fees, and social equity, can be reinterpreted in the Korean urban context.
