심각한 가정폭력의 피해자인 아내가 가정폭력의 가해자인 남편을 살해하는 사건은 사회전체가 `가정폭력이라는 범죄`의 피해자를 적절히 보호하지 못하고 그들에 대한 편견과 이해의 부족으로 그들을 또 다른 범죄자로 만든 제3차 피해자화의 예라고 볼 수 있다. 가정폭력피해 여성에 의한 배우자살인을 막기 위해서는, 첫째, 매맞는 아내에게 관한 잘못된 편견에서 탈피해야 하며, 둘째, 장기적 가정폭력으로 인해 나타나는 심리적 증상과 특성에 대해 형사사법기관의 관계자들이 정확히 이해하는 것이 선행되어야 하고, 셋째, 재판과정에서 전문가의 증언을 적극 도입하고 인정하는 방향으로 나아가야 한다. 넷째, 가정폭력에 개입할 때에는 가정폭력 가해자의 위험성에 대한 정확한 판단이 이루어 진 후 그 대응책과 피해자 보호조치가 이루어져야 한다. 다섯째, 가정폭력사범에 대한 보다 엄격한 관리가 이루어져야 한다.

This article examines what happens to a battered woman who, after years of mental and physical abuse, kills her abusive partner. The fact is that the criminal justice system that often ignored her pleas for assistance now vigorously prosecutes her as a criminal. Despite increasing public interest about domestic violence issues battered women charged with crimes specifically, there continue to be many misunderstandings and disconceptions about battered women defendants and about their legal defenses. The spouse murder involving battered women can be decreased by inter-understanding. The criminal justice system have to understand psychological phase of battered women like `battered women syndrome or PTSD` and be used expert witnesses in the trial. The NGOs must have a accurate scale of crisis level to abuser. The police, probation and Community organizations should make partnership each other. New educational, advocacy, and legal efforts are needed to counter the many problems battered women defendants continue to face today.
