이 글은 맑스의 인권 개념을 새롭게 조명해보고자 했다. 일반적으로 맑스주의에서 인권 개념은 무시되거나 배제되는 것으로 간주되어 왔다. 그러나 맑스가 근대적 인권 개념을 비판하는 것은 사회·역사적으로 만들어가는 인간적 가치를 부정했기 때문이 아니다. 맑스는 근대 산업혁명과 대공업이 ``사회적 노동``의 산물이라고 보았다. 따라서 그것은 개인의 권리나 소유로 환원될 수 없는 것이다. 그럼에도 불구하고 근대의 인권은 각 개인들을 독립적인 존재로 원자화함으로써 사적 소유를 정당화하고 풍부한 산업적 기반을 소외된 노동으로 바꾸어 놓는다. 따라서 맑스는 인권의 실현은 독립적인 ``개인``이 아니라 사회적 노동을 수행하는 ``사회적 개인들``의 연합이 되어야 한다고 보았다. 인권과 연대는 노/자의 계급적대로 환원되지 않는다. 오히려 인권은 대체 권력으로서 ``코뮌``을 구성하는 핵심 원리가 되어야 하며 노동자계급의 사회운동에서 실질적인 무기가 되어야 한다. 특히 이 글은 오늘날 적대적 모순을 전이하거나 접합시킴으로써 다양화하는 과정에서 인권과 같은 보편적 가치의 중요해진다는 점을 지적하고 있다.

The purpose of this essay is to rethinking the human right. In general, A man think that it have been bypassed and eliminated the human right from marxism. But it is a misjudgement. It is not by reason of deny a human`s universal value that Marx criticize the modern human right. Marx think that the Industrial Revolution and the manufacturing industry results from social labour. But the modern human right justified private property as making a individual into atom in view of independent being. Thus Marx asserts that realization of the human right is not made by a independent person but the combination of a social person doing social labour. The human right and solidarity isn`t reduced to the antagonism between Capital and Labour. The human right is a immediate constituent of the Commune and a actual weapon in the social movement.
