2008년 국가인권위원회에서 실시한 정신장애인 인권 실태조사에서 비자의 입원율, 장기입원, 격리, 강박 등의 가혹행위, 치료행위등과 관련한 인권침해, 사생활과 관련한 인권침해 등이 발생하고 있음이 나타났다. 이러한 인권의 문제들을 해결하기 위해 2009년 11월 국가인권보고서가 발간되었다. 본 연구는 첫째, 국가보고서가 정신장애인의 인권보호와 증진에 기여한 점과 미비한 점은 무엇인가? 둘째, 정책과제별 핵심 추진과제의 한계점 및 적용을 위한 과제는 무엇인가?에 대해 고찰을 하고자 함이다. 연구방법은 문헌고찰로서 국가보고서에서 제시한 핵심 추진과제인 입퇴원 과정에서의 적정절차 마련, 정신보건시설내 권리 보장 및 치료환경 개선, 지역사회중심의 정신장애인 치료, 정신장애인 차별과 편견해소가 실제적으로 실행되기 위해 한계점과 적용을 위한 과제를 살펴보았다. 국가 보고서의 추진 과제들이 선언적 의미로 그치는 것이 아니라 실행력을 갖추기 위해 국가인권위원회, 보건복지부, 병원 의료전문가, 지역사회정신보건전문가, 가족, 정신장애인 당사자의 점진적 변화와 행동이 필요할 시점이다. 국가보고서의 목표가 제시하는 지역사회중심의 통합적 패러다임은 향후 시설 내 치료와 보호에 의존하는 한국적 상황에서 시설 중심의 관리 방식을 탈피하고 지역사회로의 복귀와 자립을 지원하는 변화를 만들어 내야 할 것이다.
In 2008, the National Human Rights Commission of the Republic of Korea carried out an investigation on the human rights condition of the mentally disabled. The study found that many are hospitalized not by their own volition, many are hospitalized for a long period of time, many are isolated, and the treatment and privacy of this population is often times in violation of their human rights. In order to resolve this, on November 2009 a national human rights report was published. The report addresses the following questions: First, how has the national human rights report enhanced the human rights protection of the mentally disabled and what are some of its inadequacies? Second, what are the policy challenges, policy limitations and how can we better apply the policy? The research methods included a literature review of the national human rights report reviewing the limitations of the overall programs offered to the mentally disabled population such as: how appropriate procedures for the hospitalization and release from the hospital can be better implemented, how the mental health security and treatment of the mentally disabled has improved, the regional treatment of the population, and how discrimination against the mentally disabled can be eliminated. This report must be further extracted after its presentation through a joint effort towards change. The time has come for the National Human Rights Commission; the Ministry for Health, Welfare, and Family Affairs; medical specialists; local mental health professionals; the family; and the individual to take active steps towards change. The report will show the integration paradigm of the regional social welfare center. From now on, the usual treatment tactic in Korea of only receiving care in the hospital will move forth to helping the mentally disable return to society and providing the proper support towards self sufficiency.
