이 글에서는 투기에 의한 주택(및 토지)의 독과점, 그리고 이로 인해 얻어지는 불로소득이 윤리적으로 정당화될 수 있는지 분배정의의 관점에서 고찰하고자 하였다. 이 글에서는 특히 주택(및 토지)의 독과점을 옹호하는 한국 자유지상주의 계열 학자들의 입장을 비판적으로 검토하고 다음과 같은 결론에 도달하였다. (1) 주택문제는 결국 토지문제로 귀결되며, 토지는 공급이 고정된 ``유한재``임과 동시에 인간생존에 필수불가결한 ``필수재``이므로 무한정한 사유화의 대상이 아니라 공동체의 공유자산으로 간주하는 것이 정의에 부합한다. (2) 소수에 의한 주택(및 토지)의 독과점은 비소유자의 자유와 인격 실현을 방해하며, 토지가치 상승으로 인한 불로소득은 비소유자의 노력소득에 대한 지속적인 침해를 수반한다. (3) 토지가치의 상승은 철도·항만·전철·도로·전기·상하수도 등 공공시설의 건립 및 공공 서비스의 공급에 따라 결정되므로, 토지가치 상승분은 개인의 몫(desert)이 아니라 공동체의 몫으로 간주하는 것이 마땅하다. (4) 이상의 논거에 의하여, 토지 불로소득은 조세를 통하여 공동체로 환수되는 것이 정의의 원리에 부합한다. 따라서 배타적 소유권 이념에 입각하여 토지의 독과점과 불로소득을 옹호하는 한국 자유지상주의자들의 관점은 자유주의의 원리(기회균등의 원칙과 불침해의 원칙)에 위배되며, 공리주의의 원리(효율성의 원리)에도 위배된다.

In this paper I tried to examine whether an unearned income created from land-monopoly can be ethically justified. After a careful examination of Korean libertarian`s position which support the land-monopoly and unearned income, I finally arrived at the following conclusion. (1) Since land is a ``limited good`` that production and reproduction is strictly limited, and a ``necessary good`` without which human-being`s minimal self-preservation is impossible, land should be regarded as a common asset instead of a private property. (2) Monopoly of land and housing by few will not only interrupt the liberty and safety of non-owners, but also consistently inflicts harm on the earned income of non-owners. (3) Since the rise of land price is due to the public investment such as establishment of railroad, highway, harbor, subway, electricity, water supply, and gas facilities, etc., the gain obtained from the increase of land-value should be regarded as common share of a society. (4) Based upon the above reasoning, the principle of justice requires that unearned income created from the rise of land price should be reverted to the society. Accordingly, libertarian`s position in protection of land-monopoly and unearned income runs directly counter to the liberal spirit of non-harm principle and equal opportunity principle.
