한국의 대규모 금융 불안 사태의 배경에는 금융감독당국의 부실한 정책기능 및 집행기능과 사태의 발생, 그리고 감독시스템 쇄신 논의의 촉발과 뚜렷한 성과 없는 종결 사이의 악순환이 자리 잡고 있다. 본 논문은 이러한 악순환의 원인을 금융감독시스템에서 "민주적 거버넌스(democratic governance)", 곧 민간의 지지와 신뢰를 토대로 하여 효율성을 발휘하는 거버넌스의 구축노력이 전개되지 못하였다는 사실에서 발견한다. 그리고 이론적 논의를 통하여 민주적 거버넌스의 구축을 위하여 요구되는 핵심 조건들-가치체계와 제도의 조응, 시스템의 구심성 확보, 제도적 시간의 부여-을 도출한다. 이후 1990년대 후반부터정부에 의하여 진행되어 온 시스템 개편노력을 개관한 뒤 민주적 거버넌스의 관점에서 그 한계를 규명한다. 더불어 이상의 조건들을 충족시킴으로써 민주적 거번너스가 구현될 수 있는 방향에서의 시스템 개편이 추진되어야 함을 주장하고, 이를 위한 제도적 방안을 구체화한 뒤, 유의미한 함의를 제시하고자 한다. 한편 본 연구는 연구의 신뢰성 확보를 위하여 업무질의, 설립·영업·전환·합병에서의 인·허가, 검사, 약관심사 등의 업무와 관련하여 감독당국과 빈번히 접촉하는 금융기관 관계자들과의 심층면담 자료를 적극 활용하였다.

Reviewing critical financial crises in Korea, we can find out a vicious circle that connects lack of careful financial supervision, emergent of crisis, debate on the necessity of renovating the supervisory system, and the end of debate without much result. This paper argues that the lack of efforts that tries to build a "democratic governance" in financial supervisory system is the main cause of this vicious circle. It then elaborates some principal required conditions for the establishment of democratic governance, through theoretical discussion focused on "system governance app." and "radical democracy app." It further traces and examines historical processes of renovating the system since the late 1990s, and pointed out critical limitations from a viewpoint of democratic governance. And it argues a need of a full-scale renovation of the system in the direction of establishing democratic governance through fulfillment of those conditions. In-depth interviews with staffs from financial companies were adopted in order to enhance reliability of this research.
