일반적으로 동아시아의 근대는 서구의 영향 아래 성립되었다고 보며, 그 경우 근대의 중요 특징 가운데 하나가 형식이었다. 근대 이전 동아시아에 나타난 중요한 형식은 엄격한 의례(儀禮)였다. 의례는 개인부터 국가까지 사회 전체를 관통한 시스템이었다. 하지만 동아시아의 예치시스템은 근대로의 발전을 가로막은 과도한 형식주의라고 비판받아 왔다. 그렇다면 동아시아 예치시스템이 보인 과도한 형식주의를 근대 담론체계 안에서 다시 볼 수는 없는 것인가? 동아시아에서 의례는 삶 전체를 포괄하고 사람들 사이를 관계 짓는 사회 시스템이었으며, 신분적 차별을 정당화하는 문화 형식이었고, 사회 이념을 구현해 가는 교육 방법이었다. 특히 예치 시스템의 핵심은 형식이었고, 과잉된 형식의 모습을 잘 보여준 것이 조선 후기 예송이다. 하지만 그 속에는 왕실과 사대부 집안의 차별마저 넘어서는 근대의식이 담겨 있었다. 그리고 의례의 형식화와 도구화는 표준 양식을 제시했다는 합리적인 특징으로보여주기도 한다. 이 점은 서구 근대 법치주의가 형식을 통해 객관적 준칙으 로서의 법에 의한 지배를 실현하려 했던 것과 유사하다. 그 근거로 서구 법치주의는 천부인권사상을 내세웠고, 유교 의례 또한 신성화를 통해 정당성을 확립하였다. 하지만 의례는 외적 규제보다는 내적 자율성에 더 의존했다는 차이가 있다. 근대 이후 유교 의례문화는 부정해야 할 봉건적 질서였다. 하지만 여기에는 서구의 충격에서 온 동아시아의 트라우마가 담겨 있다. 예치주의의 형식화와 도구화를 역사발전 과정으로 본다면 예치시스템의 형식에서도 서구사회의 근대성을 찾을 수 있을 것이다.

Modernity in East Asia was established under the influence of the West. In that case, one of the key features of modern times was a form. Important form of pre-modern East Asia was a strict rites(儀禮). System of rites penetrated through From the individual to the whole society. But the rule of manners in East Asia has been criticized for excessive formalism that blocked development to the moderns. Then in modern discourse, excessive formalism of the rule of manners in East Asia can not be revaluated? In pre-modern East Asia, rites covered the human`s whole life. So rites was a social systems that related between people, and was a cultural form that justified the discrimination of status, and was a method of education that realized social ideas. In particular, the core of the rule of manners was a form, and the yesong(禮訟) showed figure of overflowing of form in the late period of Joseon Dynasty. But that yesong dripped with the modern sense which get over the discrimination between royal and noble families. Also the formalization and tools of rites provided a standard reasonable way. This point similar with that western modern rule of law realized the rule of law through the form as the objective standard principle. western modern rule of law nominated natural rights of man as basis and rites of confucianism established justification through holism also. But the rites depend on the internal autonomy rather than the external regulation. That is the different point. In modern times confucian rites is the vestige of feudal society. But that point of view trauma from Western impact. If we acknowledge that the formalization and tools of rites as progressive process of history, we can find western modernity from the ritual system of premodern East-Asia.
