최근 한국 소설에서 법과 관련된 서사들이 많이 생각되고 있다. 본 연구의 텍스트인 『도가니』는 정신지체아 학교에서 일어난 성폭행과 폭력을 다룬 작품으로, 실화를 바탕으로 전개된 만큼 사회적 파장을 불러온 작품이다. 문학과 법은 본질적으로 (1) 인간의 삶과 사회를 다루고, (2) 언어적 해석과 비평에 기초하는 특질을 공유한다. 본 논문은 이 접점을 바탕으로 시의성과 대표성을 띠는 텍스트의 안팎을 조명함으로써 공공의 상상력으로서 문학적 상상력, 특히 법의 문학적 수용을 검토함으로써 ``법문학``의 가능성을 탐색한다. 본 연구를 통해 각 소설 속에서 등장인물이 처한 상황에 법적인 판단을 형상화한 작가의 인식과 작품에 나타난 법감정 등을 해석해보는 과정은 법의 문학적 수용과 법과 관련된 문학적 인식의 궤적을 살피는 데 필요한 작업이다. 문학은 소외집단이 갖는 문제들을 감수성에 닿는 형태로 고발하여 감동과 공감, 더 나아가 법제(개)정의 추동력이나 법해석의 근거를 끌어낸다. 인권 담론이 인간의 소외와 상처, 치유와 회복을 다루는 것이라면, 특히 문학적 ``공감``은 인권을 가능하게 하는 힘으로 작용한다. 더 나아가 법문학에 대한 인식과 방법론을 확대하기 위해서 (1) 문학의 언어가 새로운 법인식을 가져다주는 방식으로서 내레이션의 특징과 역할, (2) 문학에서 자주 등장하는 사건에 대한 작가의 묘사기법과 법학 기술의 관련성, (3) 형식, 실체, 선판례 등의 관점에서 일정한 형식을 준수할 것을 요구하는 동시에 표현에 있어서의 창의성이 극도로 존중되는 특수한 문학적 장르로서의 판결문, (4) 도덕의 재구성을 위한 실질적인 인식방법의 훈련이자 새로운 윤리적인 입장을 배우기 위한 법학의 글쓰기 등의 연구가 요청된다.

This study aims to examine the possibility of law and literature, focusing on Doganiwhich presents to sexual violence of the child with the disability. The literature and the law essentially deal with the human life and society, and they share on the characteristic based on linguistic interpretation and criticism. It is necessary to expand to the consciousness and the method on law and literature. The topic runs as follows. (1) The distinctive feature and the role of narration as the way which brings the literary language to the new thought of the law, (2) The author`s representation on the event in literature and the relation to the description of the law, (3) The decision as the particular literary genre in terms of the substance and the judicial precedent which are demanded to a certain form and the creativity. (4) The law writing of the real thinking way for reconstruction of the new morality and the ethics. It`s important that this attempt show the new topic and more than that, the interdisciplinary possibility on the political, ethical, artistic implication and meaning. So I think I`m going to complement to the exact theory and the suitable for the case on this subject.
