이 연구는 개인정보보호법 제정 사례를 정책흐름모형을 이용한 시기별 비교분석을 통해 살펴보았다. 노무현 정부시기에 초점사건의 대두와 대통령의 적극적 관심 하에 정책이 시작되어 정부의제의 창은 열렸지만, 정책선도자의 부재로 결정의제의 창이 열리지 않음으로써 정책 산출에 실패하였다. 이명박 시기에 정권 교체에서 오는 정치적 흐름의 변화와 행정안전부라는 정책선도자의 정책대안에 대한 지속적인 수정·협상 노력이 정책의 창을 통해 최종 정책 산출에 이르게 하였다. 이 사례는 우리나라의 입법과정에서 정치흐름과 정책선도자의 중요성을 다시 한번 확인시켜 주고 있으며, 앞으로 정책흐름모형을 입법과정 분석에 보다 폭넓게 활용할 수 있는 가능성을 보여준다.

This study aims to analyze the lawmaking process of Personal Information Protection Law by utilizing policy streams model. In Roh government(2003-2008), the window of decision agenda didn’t open due to the absence of policy entrepreneur although the window of governmental agenda opened by focuses event and the president’s attention. Policy actors failed to produce policy output. However, in Lee government(2008-2013), policy actors produced the policy output by the change of political stream(the regime change) and the role of policy entrepreneur(Ministry of Public Administration and Security). This case shows once again that policy stream and policy entrepreneur in lawmaking process is very important. Also researchers are able to apply policy streams model more widely in lawmaking process analysis.
