본 연구는 환경분쟁의 현황과 특징을 체계적으로 살펴보기 위해 실증적 분석을 시도하였다. 1990년부터 2011년까지 발생한 총 184건의 환경분쟁사례들을 대상으로 쟁점분야, 분쟁당사자, 쟁점특성, 분쟁종결방식, 분쟁결과 등의 변수들을 중심으로 분석하였다. 분석결과, 환경분쟁이 점차 증가하고 있으며, 분쟁이 발생하면 해결되지 않고 장기화되는 경향이 나타났다. 또한 협상, 조정과 같은 대안적 방식으로 종결된 분쟁이 법원판결과 같은 전통적 방식으로 종결된 분쟁에 비해 종결후 반발이 적고 분쟁기간이 짧은 반면, 사업이나 정책이 백지화되거나 실행되는 데에는 큰 차이가 없었다. 본 연구결과는 환경분쟁이 다양한 변수들에 의해 영향을 받는 것을 실증적으로 보여줌으로써, 합리적인 분쟁해결방안을 모색하는 데 이러한 점들을 고려할 필요가 있음을 시사해주고 있다.
This study aims to find the characteristics and trends of environmental disputes through empirical analysis. A total of 184 cases which occurred between 1990 and 2011 are analyzed according to the variables of environmental disputes, i.e., disputing party, issue, dispute resolution, policy outcome. Results show that environmental disputes increase over time and tend to be protracted. Also, the disputes used by ADR techniques such as negotiation and mediation take less time to be resolved and have more compliance with outcome over time compared to the ones by traditional methods, while both have no difference in whether policy is implemented or not. Implications and limitations of this study are discussed.
