이 연구는 국민기초생활보장법상의 권리가 무엇이고 시행 이후 현재까지 권리수준에 변화가 있는지 그 변천과정을 살펴보았다. 그리고 변천에 담긴 함의를 찾고 확충방안을 제시하였다. 연구방법으로는 기술적 연구에 따른 내용 분석 방법을 사용하였다. 연구결과, 실체적 권리로서 급여청구권을 가지고 있었고 그 권리보장 수준은 보통이었다. 또한 절차적 권리로서 행정소송권은 청문에 관해서 권리보장 수준이 높았고 이의신청은 권리보장 수준이 보통이었다. 행정참가권의 권리보장 수준은 높았고 입법청구권은 낮았다. 끝으로 수속적 권리보장 수준은 보통이었지만 자활급여 대상자의 권리보장 수준은 높았다. 이러한 권리보장과 관련한 변화는 수급권자의 범위가 점차 확대되고는 있지만 근로능력 향상과 고용 촉진정책이 강화되고 있다는 점도 나타났다. 확충방안으로는 첫째, 수급권을 보장하기 위한 부양의무자의 기준 폐지와 외국인에 대한 특례와 차상위계층에 관한 규정 완화, 둘째, 근로능력자에 대한 조건부 수급 규정 폐지, 셋째, 이의신청기간 동안 급여 제공, 넷째, 생활보장위원회 위원에 수급권자 대표의 포함을 제시하였다.

The research method of content analysis method was used according to the descriptive studies. The study had as a substantial rights to benefit claims right, the rights guaranteed level was normal. Administrative litigation rights as procedural rights when it comes to hearing higher level of rights guaranteed, a formal objection the rights guaranteed level was normal. administrative participation right the rights guaranteed level was higher, the legislation claims rights were lower. finally, the process rights guaranteed level was normal but higher level of self-supporting benefit of those rights guaranteed. Improvements to the first, criteria abolished of the stimulus duty to ensure the entitlement, an exception for foreign, easing regulations on the next higher layer second, abolition of conditional eligibility rules for Working persons third, during the appeal period a benefit offer fourth, livelihood security committee members have presented so that it can be Inclusion recipients.
