지방자치제가 다시 부활한지 20년이 지났다. 20년 전 부활 당시부터 지방자치제와 관련하여 지금까지 끊임없이 제기되는 논쟁 가운데 하나가 바로 지방선거에서 정당의 후보자추천을 허용할 것인가의 문제이다. 지방선거에서의 정당공천 허용 논쟁은 2003년 헌법재판소가 공직선거법상 기초의회의원선거 후보자의 정당표방금지조항에 대하여 위헌결정을 선고한 이후 공직선거법이 모든 공직선거에서 정당의 후보자추천과 후보자의 정당표방을 허용함으로써 더욱 가열되었다. 지방선거에서 정당의 후보자추천을 허용할 것인가의 문제를 해결함에 있어서는 민주주의적 요청과 지방자치제의 발전이라는 요청이 조화를 이룰 수 있는 방안을 모색하여야 한다. 여기에 더하여 우리의 정치현실과 문화, 정당 현실과 정당의 민주화 정도도 고려하여야 한다. 이와 같은 모든 요소를 종합하여 고려해 볼 때 현재 우리나라의 실정에서 지방자치제가 정착하고 발전하기 위해서는 기초지방자치단체 차원의 선거에서는 정당공천을 불허하고 광역지방자치단체 차원의 선거에서는 정당공천을 허용하는 방안이 가장 합리적이고 타당하다고 할 것이다. 다만, 기초지방선거에서 정당공천을 허용하지 않는다면 후보자의 정치적 표현의 자유를 제약하는 측면이 있으므로 보완적 조치로서 후보자가 자신이 지지하는 정당을 표방할 수 있도록 허용하고 정당원으로서의 경력표시는 가능하도록 하여야 할 것이다.

The 6th Local Election will be held next year. There has been controversy over a permission of public recommendation by party in the local election since 1991. The opinion that the party should recommend a candidate in the local election stresses the value of party politics in a democracy. On the other hand the opinion which the party should not recommend a candidate in the local election puts an emphasis on development of local self-government. Our Constitutional Court decided that the electoral law clause of the prohibition on a specific party`s endorsement for the candidate is unconstitutional in 2003. I think that we approach the problem of the a party`s public recommendation of a candidate in local election considering the progress of local self-government and the realization of democracy in local self-government. Considering that our system of a local autonomous entity is two-layer system, party recommendation should be not permitted in the local election of Primary local authority. whereas party recommendation should be permitted in the local election of metropolitan council. My point of view must be a great help to all of the development of local self-government and the realization of democracy in local self-government.
