한국형 배심제도로서 국민참여재판이 도입되어 있다. 이러한 국민참여재판은 배심원이 유ㆍ무죄에 관한 평결을 하고, 양형에 관한 의견을 제시할 수 있으되 법적 구속력을 인정하지 않는다는데 특징이 있다. 국민참여재판은 헌법상 보장된 재판받을 권리의 관점에서 정당화되고, 구체화되어야 한다. 헌법상 보장된 재판받을 권리에 따르면 헌법이 요구하는 재판은 헌법과 법률이 정한 법관에 의한 재판이다. 헌법과 법률이 정한 법관이 직업법관으로 이해되는 경우에 배심제는 재판 받을 권리를 침해할 수 있다. 하지만 이러한 재판을 받을 권리는 제한될 수 있다. 그러나 재판을 받을 권리를 제한하는 경우에도 기본권제한에 관한 헌법적 원칙인 비례성원칙을 준수해야 한다. 이에 따라 직업법관에 의한 재판을 통해 실현하려는 재판의 전문성과 배심원단에 의한 재판을 통해 실현하려는 재판의 민주성은 균형을 이루어야 한다. 재판에 대해서 요구되는 전문성과 민주성을 고려하여 배심원단의 권한, 배심재판의 범위, 배심재판의 강제, 배심원단 평결의 법적 구속력, 배심원단 평결의 정족수 등에 관한 합리적 대안이 모색되어야 한다.

The public participation trial as Korean jury trial system is introduced. The public participation trial is characterized by that the jury is able to provide an opinion on the verdict of guilty and the sentencing, but the opinion is not legally binding. The public participation trial shall be justified and embodied from the point of view of the constitutionally guaranteed right to a trial. According to the constitutionally guaranteed right to a trial, the trial as required by the Constitution is the trial by a judge designated by the Constitution and laws. If the judge designated by the Constitution and laws is understood as the professional judges, the jury system infringes the right to a trial. However, the right to a trial may be limited. Even if the right to a trial is limited, the principle of proportionality as the constitutional principle concerning the fundamental rights limits must be complied. Accordingly, the expertise of the trial realized by the professional judges and the democracy of the trial realized by the jury trial must be balanced. Considering the democracy and the expertise required for the trial, reasonable alternatives should be sought regarding the authority of the jury, the scope of the jury trial, the legal binding force of jury`s verdict and the quorum of jury verdict etc.
