최근 도심지 대상의 대규모 도시재개발사업에 있어, 지역사회의 참여를 통한 도시재생적 가치의 중요성이 강조되고 있다. 이는 지역사회가 가진 참여적 견제역할을 통해 지역민에 대한 배려 나아가 공정한 개발혜택 분배 그리고 사회적 갈등의 최소화를 목적하며, 궁극적으로 개발사업을 통한 경제적 균형을 제공하는 지역사회재생을 목표한다. 이에 본 연구는 미국 도시개발의 시민참여와 저항의 역사 속에서 그 사고적 배경의 발전을 살펴보고, 그 대표적인 제도적 적용사례로 아틀란틱 야드 지역혜택협약의 분석을 통해 협약이 기여한 선의적 역할을 중심으로 관련 시사점을 도출하였다. 그 항목은 다음과 같다. (1)지역사회에게 직접적 참여를 통한 상향적 견제권한 제공 (2)기존 토지이용과정에 포함되지 않는 부문의 논의 제공 (3)개발에 대한 지역사회의 지원으로 사업의 확실성 제공 (4)공공부문과의 협상 보다 혜택의 사회적/재정적 가치 향상 (5)사업의 추진과 인허가 과정의 공공부문의 정치적 부담경감 (6)지역사회, 개발사업자, 공공부문을 위한 상생적 개발형성. 이러한 과정으로, 사회적 합의에 기초한 건전한 혼합소득지역의 구성과 사회통합적 개발의 방법론을 살펴봄을 통해 향후 국내 도시재개발사업이 참조할 수 있는 하는 시사점을 도출하였다.

Recently, There are increasing numbers of important matters on achieving regenerative values by enforcing community participation in large scale redevelopments in urban areas. Community`s participations create on development that affects themselves provides checks and balance ability to gain consideration on the people in the affected community moreover equal profit sharing as well as minimizing possibilities on social conflicts. In the long run, aims to achieve community regenerative purposes by allowing economic equality between developers & communities. Within this context, this study looks into American history regarding civil participation and resistance against urban renewal to find development of theoretical background on the issue. Then analyze Atlantic Yards community benefits agreement as an institutional application focusing on contributions by its virtuous roles with following criteria to be used as implication possibly reflected on domestic situations. (1)Community`s upward check and balance authority by direct participations (2)Provision of benefits excluded in conventional land use process (3)Provision of development project`s certainty (4)Provision of benefits have superior socio-economic values compare to negotiating with public sectors (5)Reducing public sector`s political risks and burdens (6)Creating win-win-win strategy for all three parties(Community, Developer, Government)
