이 글은 현행 사이버 ``테러`` 대응체제의 문제점을 지적하기 위한 글이다. 특히 사이버 ``테러``에 대한 개념설정과 대응구조에 주목하고 있다. 이 두 가지의 요소에 대한 개선이, 우리나라의 무력한 대응력 극복을 위한 핵심이라고 판단하기 때문이다. 글의 전반부에는 사이버 ``테러``의 정의와 유형을 분석하여, 기존의 사이버 ``테러``개념설정에 대한 문제점을 검토한다. 추상적 개념들의 무의미한 나열에 불과한 현재의 정의와 소위 ``분류를 위한 분류``에 그치고 있는 현재의 유형은, 실전에 있어서는 무용지물이기 때문이다. 한편 글의 후반부에서는 사이버 ``테러``에 관한 대응구조의 문제점을 살핀다. 전형적인 분산형 대응체계를 구성하고 있는 현행의 대응구조가 가져오는 비효율성을 알아보고, 입법적 혼란과 ``컨트롤 타워``설정의 오류로 인한 모순점을 비판적 시각에서 검토한다. 이러한 문제에 관하여 필자는, 효율적인 대응체제로의 재구성을 제시한다. 미래지향적인 열린 개념인 동시에 지금의 모호함을 시정하여 명확한 기준으로 기능할 수 있는 개념의 설정, 그리고 상이한 보호이익을 가진 각 섹터들이 모두 전면으로 등장할 수 있는 새로운 통합형 체계의 마련과 정합성과 일관성을 확보할 수 있는 입법체계의 재구성이 필요하다는 것이 이 글의 결론이다.
This paper aims at pointing out several problems on the current countermeasure system against cyber ``terror`` in Korea, focusing, in particular, on the definition of cyber ``terror`` and the structure of the system. For the improvement of these two factors are the kernel in overcoming the ineffective ability of the system to cope with cyber ``terror``. The first part of this article is assigned to a critical assessment of the existing conception of cyber ``terror``. Analyzing the definition and categorization of cyber ``terror``, I contend that the current definition enumerating meaninglessly abstract concepts, and the categorization which is nothing but a classification for classification, are a white elephant in a real fight against cyber ``terror``. In the latter part of this article, then, I examined the structure of the countermeasure system against cyber ``terror``. Here, I ascertained the inefficiency of the system resulted from its distributed structure, and criticized the confusion in related legislations and the inconsistencies caused by the ill-devised control tower. In conclusion, I proposed to redesign a system to effectively engage with cyber ``terror``. That system must be equipped with some devices as follows: a future-oriented open concept of cyber ``terror`` which can function as a clear criteria; an integrated structure that can maximize the capability of various sectors each of which serves its own independent interests, and a structure of legislation with coordination and consistency.
