미국 대학입시에 있어 인종적 다양성 고려를 위한 적극적 평등실현조치 -미연방대법원 최근판례 Fisher v. University of Texas(2013)를 중심으로-

한국사회에서 전체 결혼대비 國際結婚의 비율은 2013년 기준 약 8%이다. 國際結婚이 한국사회에 가져올 수 있는 인종적, 문화적 다양성은 한국사회를 ``다문화사회``로 이끌고 있는데 일조하고 있다. 대한민국의 다문화 지원정책에 따른 다문화 가정의 증가와 이들 사이에서 태어나고 자란 자녀들의 본격적인 대학입학 시기가 멀지 않은 시점에서, 다문화자녀들의 고등교육 기회제공을 도울 수 있는 정책적 검토가 필요할 수 있다. 이러한 측면에서, 대표적 다문화 국가 미국의 대학입시에 있어 다문화 배려 정책은 시사점을 제공한다. 한국과 미국의 대학입시에 있어, 적극적 평등실현조치(affirmative action)의 지지근거의 배경차이가 존재함에도 불구하고, 공유될 수 있는 부분이 있다. 인종적 다양성이 반영된 학생선발을 통해, 다양한 사고와 경험을 공유할 수 있는 교육환경을 제공하고, 그러한 교육환경에서 비판과 토론을 통해 올바른 세계관을 가진 지도자를 양성한다는 것은 분명 국가의 ``긴절(緊切)한 이익(compelling interest)``에 해당된다. 동 근거는 현재 미국 대학입시에서 적극적 평등실현조치가 지지되는 근거로서, 추후 다문화 관련 대학입학정책 논지로 한국에서 비교 검토할 가치가 있어 보인다. 대학입시에 있어 적극적 평등실현조치는 그 필요 배경에 있어 양국은 상이점이 있을 지라도, ``다문화 및 다양성의 존중`` 관련 법 담론은 공유할 수 있는 부분이 있어 보인다. 미국연방대법원의 대학입시 관련 가장 최근 판결로는 2013년 6월 24일 선고된 Fisher v. University of Texas가 있다. Fisher 판결에서는 대학당국의 인종고려 입학조치가 ``엄격심사``를 통과할 수 있는지 여부를 법원 스스로 확인하고 검토하고자 하는 의지를 보여준 점에서 선례와 구별될 수 있다. 다시 말해, 당해 대학이 주장하고 있는 ``긴절한 이익``에 관한 주장을 존중, 그대로 인용할 것이 아니라, 법원 자신이, 주체적으로 이 부분에 대해 판단할 필요가 있다고 보았다. 대학의 교육적 목표에 따른 입학사정에 관한 결정권을 존중해주려고 했던, Grutter v. Bollinger(2003) 판결의 다수 법관의 의지와는 달리, 현행 연방대법원의 다수 대법관은 이를 직접적으로 심사할 필요가 있다고 함으로써, 개별대학이 善意(good faith)를 가지고 교육 목표에 따른 결정이, 법원에 의해 인용되기가 종래보다 어려워 질 가능성이 있으므로, 이는 대학 당국의 교육관련 자치성에 부정적인 영향을 줄 수 있다는 우려의 목소리도 있다. 한편, 동대법원은 입학사정에 있어 적극적 평등실현조치 자체가 위헌임을 확인하지는 않았으므로, 여전히 대학에서 구성원의 다양성을 확보키 위해서 입학사정에서 인종을 고려를 허용했던 동법원의 先例, Grutter v. Bollinger(2003) 판결은 유효하다고 볼 수 있다. Fisher 판결은 Bollinger 판결을 파기하지는 않았음에도 불구하고, 연방대법원 다수 대법관의 입장 변화추의를 보여주고 있으며, 동 정책관련 사법 당국의 ``금지→허용→허용의 축소``로의 의지 변화를 감지할 수 있다. 본 연구의 목적은 미국 대학입시에 있어 적극적 평등실현조치 주요 쟁점 및 관련 판례를 중심으로 검토하는 데 제한되며, 동 분석은 차후 한국에서 다문화 자녀들의 대학입학이 본격화되는 시점에 예상되는 관련 헌법소송 및 관련 분야의 연구에 참고 자료로 활용될 수 있도록 기여하는데 의의를 가진다.

As of 2013, the percentage of international marriages is around 8% among whole marriages in South Korea. Racial and cultural diversities promoted by international marriages have supported Korea becoming ``a multicultural society. `` With the supporting policy for the diversity in Korea, the number of children in multicultural families increases and the time of entering into universities of the children is not far from now, therefore, the policy evaluation for helping multicultural children to have a chance to get into higher education institutions is necessary. In terms of this, the U. S. perspectives on college admissions for diversity could provide a thought-provoking. Though differences of background for supporting the policy of affirmative action exist between South Korea and the U. S. , there are perspectives we may share. It must be a government`s compelling interest: selecting students in consideration with racial diversity, and educating future leaders who have right perspectives benefited from criticism and discussion under this educational background. This ground is used for supporting affirmative action in the current college admissions in the U. S. , and we may evaluate some perspectives of the U. S. as research models for our near future college admission policy for multi-culture. Though there are differences in the background for affirmative action between both countries, many parts of legal discussion on ``multi-culture or respect of diversity`` could be shared. The most recent college admission related case of the U. S. Supreme Court is Fisher v. University of Texas, which was sentenced on June 24, 2013. Fisher has its own distinction with precedents in terms of showing the Supreme Court`s willingness applying ``strict scrutiny`` in race considered college admission. In other words, the Supreme Court recognized that courts should not automatically admit university`s argument for ``compelling interest`` but courts need to make a decision regarding this thoroughly. Unlike the majority opinion in Grutter v. Bollinger(2003), which respected university`s decision making process pursuing to the university`s academic goal, the majority opinion of the current Supreme Court states that courts should examine this. Therefore, each university might be subject to the difficulty to decide its academic goal, including racial diversity, with good faith, and this might influence on university`s autonomy regarding their academic goals. On the other hand, the Supreme Court did not find that affirmative action is unconstitutional, the Court`s precedent, Grutter v. Bollinger(2003) - allowing race as one of evaluating factors for the purpose of diversity of university students - is still a valid case law. Though Fisher did not vacate Bollinger, the majority of the Supreme Court Justices show their different perspectives regarding affirmative action which move ``prohibition→permission→decreased permission. ``The purpose of this research is limited to examine key points and relevant cases regarding affirmative action. This research might have values for contributing other or future researches on plausible constitutional litigations and relevant studies in South Korea.
