환경은 인간이 최소한의 삶을 누릴 수 있도록 직접 또는 간접으로 영향을 주는 자연적 조건이나 사회적 상황으로， 인간이 생활하는 주위의 상태를 의미한다 이러한 환경의 오염은 인간에 대한 생명의 위협으로 직결되는 것이다 그러나 과거 인간은 자연을 이용 가능한 자원으로 인식하였지， 보호하여야 할 대상으로 생각하지는 않았고，그 결과 오늘날 환경은 심각하게 오염되거나 훼손되었으며， 인간의 삶 역시 건강하고 쾌적한 생활을 위협받게 된 것이다. 특히， 오늘날 전 세계의 모든 제품을 생산하고 있는 중국은 경제성장만을 염두해 둔 채 국가를 운영하였던 탓에 환경오염에 대한 피해는 더욱 클 수 밖에 없었다 반면，경제성장에 따라 국민 소득수준이 향상된 중국 국민들은 더이상의 이러한 환경오염을 간과하지 않고，중국 정부에 환경오염대책을 촉구하기에 이르렀다 이에 따라 중국 정부는 환경에 대한 여러 정책을 내놓았지만，이는 선언적인 정책에 불과할 뿐，제대로 시행되거나 집행이 이루어지는 경우가 많지 않아 실질적인 효과를 거두지 못했다. 이는 중국 정부가 내놓았던 환경에 대한 정책이 사후 대책에 불과할 뿐，환경오염 방지를 위한 사전 예방적 대책이 아니었던 것도 중요한 원인이다. 따라서 본 논문에서는 환경법률 체계의 문제점과 개선책을 고찰하여 환경오염방지를 위한 사전 예방적이고 근본적인 해결방안의 기초를 마련하고자 한다 이를 위해 우선，중국의 환경오염이 세계적인 환경문제로 전이될 수 있는 심각한 상황임을 중국의 대기오염실태를 통해 상기하고， 우리나라와 상이한 중국의 입법체계와 환경법체계를 살펴본 후，중국의 환경법제 중 헌법，환경보호법， 환경단행법규의 문제점과 그 개선방안을 연구하였다. 특히 헌법상 국민의 권리로서의 환경권과 환경보호의무의 규정 신설 및 헌법의 편제，20144. 24 수정통과되어 2015. 1. 1 부로 시행예정인 환경보호법의 법적 지위，환경 단행법규의 단순화，체계화를 통한 개선방안을 살펴보고자 하였다.
