모든 인권을 차별 없이 보호하고 증진하는 것은 법치국가의 기본 이념이다. 국가는 기본적인 인권보장을 통하여 모든 사람의 성별, 인종, 민족 등의 어떠한 조건에도 개의치 않고 존엄하게 살 수 있도록 보장해야 한다. 미주인권협약과 같은 지역적 인권보장 제도들은 국내 사법 체계가 무너졌을 때, 인권침해에 대한 정의와 배상 추구의 길을 모든 사람에게 보장하기 위해 성립된 것이다. 미주인권위원회와 미주인권재판소로 구성된 미주 지역 인권보호체제는 미주 전역에 걸쳐 국내법에 규정된 보호를 강화하기 위한 필수적인 보완체계이다. 미주인권재판소는 미주인권협약을 실효적 보장을 목적으로 설립하였다. 미주인권재판소는 미주지역의 인권침해 사건을 심리하고 판결하여 해당 국가에게 판결을 내린다. 그러나 미주인권재판소가 인권을 보장하기 위하여 내린 판결을 해당 국가가 제대로 이행하지 않는다면 미주인권협약상의 권리내용은 문언적, 형식적인 것이 될 것이다. 그래서 미주인권협약은 명문으로 체약국에게 미주인권재판소의 판결준수의무를 부여하고 있다. 판결준수의무는 기본적 인권보장을 위하여 체결한 지역적 인권협약을 실효적으로 보장하고, 현실적으로 이행하기 위하여 중요하다. 미주인권재판소가 인권침해와 관련하여 사건이 제소되고 인권침해가 있다고 판결하면 해당 국가는 인권침해행위와 관련이 있는 법과 제도의 정비 등으로 판결을 준수하려는 사례가 증가하고 있다. 미주인권협약 체약국들은 아직 경제적인 불안정 등으로 인하여 외형적인 안정과 발전을 최우선 국정운영관제로 추진하는 외형적 성장에 중점을 두고 있기 때문에 인권은 다음 시기나 다음 세대로 미루거나 당연한 희생으로 인식하는 경우가 많다. 결과적으로 인권의 보장은 인간의 천부적인 권리의 보장이라는 근본이념을 기반으로 외형이나 지역과 상관없이 지속적으로 보장해야 한다는 대전제를 중심으로 본 논문에서는 미주인권협약 체약국들의 인권상황에 대하여 기본적으로 검토하고자 한다. 또한 미주인권협약상 미주인권재판소의 판결준수의 의무의 근거와 이행 실태, 미주인권협약 체약국들의 사회적, 정치적 상황에 인한 판결준수의무의 이행의 제한 부분에 대하여 미주인권재판소 결정례를 중심으로 고찰하고자 한다.
What protects and promotes all the human rights without distinction is the basic ideology of a law-governed country. Through the basic human rights guarantee, a country needs to secure so that everybody can live with dignity regardless of any conditions such as gender, race, and nation. The regional human rights protection systems like the American Convention on Human Rights are those that were established in order to secure everybody``s way to pursue definition and compensation for the human rights violations when the domestic judicial system would collapse. The system of human rights protection in the American continent, which is composed of IACHR (Inter-American Commission on Human Rights) and Inter-American Court of Human Rights, is the essentially complement system for reinforcing the protection that is prescribed in the domestic law across the Americas. The Inter-American Court of Human Rights was established for the effective guarantee of the American Convention on Human Rights. The Inter- American Court of Human Rights delivers judgement to the corresponding state by hearing and deciding a human rights violation case in the American continent. However, if the corresponding country doesn``t properly fulfill the judgement that the Inter-American Court of Human Rights made for the human rights guarantee, the right contents in light of the American Convention on Human Rights will be what is literal and formal. Hence, the American Convention on Human Rights is giving the duty of compliance with ruling in the Inter-American Court of Human Rights to the treaty powers in express terms. This study aims to consider the actual condition of the contents and the execution on the duty of compliance with ruling in light of the American Convention on Human Right focusing on the judgements made by the Inter-American Court of Human Rights.
