조건적 평등은 ‘이유 없는 차별 금지’의 원칙을 바탕으로 유사한 경우는 유사하게, 서로 다른 경우는 서로 다르게 대우할 것을 요구하며, 이를 위해 일정한 규칙을 적용한다. 그런데 일정한 규칙이 엄격하게 준수된다고 해서 이것이 실질적 평등을 보장해 주는 것은 아니다. 실질적 평등이 실현되기 위해서는 평등한 권리를 부여하는 근거가 중요하다. 여기서는 벌린, 롤즈, 싱어 등의 주장을 중심으로 평등 원리의 정당화 근거에 대해 고찰한다. 롤즈는 평등의 근거로 정의감과 같은 도덕적 인격을 제시한다. 그는 ‘영역 성질’ 개념을 통해 정의감의 능력을 최소치만 갖고 있다고 하더라도 평등한 대우의 근거가 된다고 보았다. 하지만 정의감과 같은 자연적 능력에서 최소치를 갖는 것도 우연적인데 그러한 우연적 요인을 용인하는 것은 롤즈 자신의 이론적 전제에 어긋난다. 또한 그러한 최소치의 경계선을 어디에 그어야 하는지, 왜 정의감이 경계선을 확정하는 데 결정적인 요인이 되어야 하는지에 대한 설득력 있는 답변을 제시하지 못하고 있다. 싱어는 정의감과 같은 자연적 특성에 의존해서는 평등의 근거를 정당화하기 어렵다고 비판하면서 ‘이익 평등 고려의 원칙’을 내세운다. 이익, 즉 쾌고 감수능력을 갖는 존재는 모두 평등하게 고려해야 한다는 것이다. 하지만 이익이나 쾌고 감수의 능력도 자연적 성질이라는 점에서 롤즈에게 가해진 비판과 유사한 비판을 싱어도 받을 수 있다. 왜 쾌고 감수 능력이 평등의 근거로서 결정적으로 중요한지, 그러한 능력을 가졌다고 해서 왜 평등하게 대우해야 하는지 등의 문제가 제기될 수 있다. 싱어는 자신의 공리주의적 관점이 롤즈의 계약론적 관점에 비해 더 쉽게 받아들일 수 있다고 주장하지만 이에 대한 합당한 근거를 제시하고 있지는 못하다. 인간 평등의 이념은 자율성과 공감의 능력을 바탕으로 근대에 형성된 것으로서 문화적 실천의 산물이라고 보아야 하며, 따라서 평등의 가치와 정당화 근거에 대한 탐구작업은 지속적으로 이루어질 필요가 있다.
The principle of conditional equality claims that similar cases should be treated similarly and different cases should be treated differently, and applies rules to those cases. Although a certain rule is strictly observed, this doesn``t guarantee substantive equality. It is important to present reasons for equal right to realize substantive equality. This paper inquires into the justificatory grounds of equality principles of I. Berlin, J. Rawls and P. Singer. J. Rawls regards moral personality such as a sense of justice as grounds of equality and makes use of the ‘range property’ concept. It is a chance to have a minimum of natural ability such as a sense of justice. So it is contradictory to his theoretical assumptions to approve the chance factor. Where we should draw the boundary line of its minimum? Why is a sense of justice the decisive factor in drawing the boundary line? He doesn``t propose persuasive answers to these questions. P. Singer maintains that it is difficult to justify the grounds of equality by virtue of natural factors such as a sense of justice. He insists on the principle of equal consideration of interests. The principle claims that we should considerate equally all the beings having interests, the abilities of feeling pleasures and pains. Interests or the abilities of feeling pleasures and pains are natural properties, so I criticize P. Singer``s arguments in the same ways as I criticize J. Rawls``s arguments. Why should we regard the abilities of feeling pleasures and pains as the decisive factor of the grounds of equality? Why should we treat equally the beings having the ability? Although P. Singer maintains that his viewpoint of utilitarian theory is more plausible than J. Rawls``s that of contractarian theory, he doesn``t present the proper reasons of that arguments. The idea of human equality was made in the modern times by the abilities of sympathy and autonomy of humankind, so the idea is the product of cultural practices. We ought to constantly inquire into the values of equality and its justificatory grounds.
