부당해고 피해자의 임금채권 보장 -"임금 상당액"의 해석 및 근로자의 권리구제 지연 문제

임금채권보장제도는 기업의 도산 등으로 인하여 임금 등을 지급받지 못하고 퇴직한 근로자가 일정한 기간 내에 미지급 임금 등에 대하여 지급을 청구하는 경우에 국가가 일정범위 내에서 사업주를 대신해서 체당금(替當金)을 지급하는 제도이며, 이 경우 국가는 근로자에게 지급한 임금 등의 범위 내에서 당해 근로자가 사업주에 대하여 가지고 있던 미지급 임금 등의 청구권을 대위행사 하게 된다. 한편 부당해고는 사법(私法)상 무효이며, 근로자는 부당해고기간 중에 근로제공을 하였을 경우에 받을 수 있는 반대급부인 임금의 지급을 청구할 수 있다는 것이 판례의 입장인바, 따라서 부당해고를 당한 근로자는 해고무효의 확인과 미지급 임금의 지급을 소구할 수 있다. 근로기준법은 이같은 사법적 구제수단에 더하여, 부당해고를 당한 근로자로 하여금 노동위원회에 구제신청을 할수 있도록 규정하고 있다(근로기준법 제28조 제1항). 노동위원회는 부당해고 등이 성립한다고 판정하면 사용자에게 구제명령을 하여야 하고(같은 법 제30조 제1항), 근로자가 원직복직을 원하지 아니하면 원직복직을 명하는 대신 근로자가 해고기간 동안 근로를 제공하였더라면 받을 수 있었던 임금 상당액 이상의 금품을 근로자에게 지급하도록 명할 수 있다(동조 제3항). 문제는 판례가 부당해고를 당한 근로자가 부당해고기간 중에 근로제공을 하였을 경우에 받을 수 있는 반대급부인 ‘임금’의 지급을 청구할 수 있다는 입장인데 비하여, 노동위원회는 구제명령으로 원직복직명령과 함께 ‘임금 상당액’(원직복직을 원하지 아니하면 ‘임금 상당액 이상의 금품’)의 지급을 명하고 있는바, ‘임금 상당액’의 법적 성질 및 체당금 지급대상에의 포함 여부에 대한 고용노동부와 중앙 행정심판위원회의 입장이 상반되어 있다는 점이다. 그리고 이 같은 이견의 존재는, 임금 상당액을 지급하라는 구제명령을 받고도 이를 지급받지 못한 채 퇴직하고 체당금을 신청한 근로자의 권리 구제를 지연시키고 있다. 이 같은 실무는, 임금 등을 지급받지 못하고 퇴직한 근로자에게 그 지급을 보장하는 조치를 마련함으로써 근로자의 생활안정에 이바지한다는 임금채권보장법의 목적에 부합하지 못하는 것임은 물론, 부당해고를 당하고도 그 현실적인 구제조차 받지 못한 근로자의 생존권마저 위태롭게 하고 있다. 이에 필자는, 임금 상당액의 법적 성질 및 체당금 지급 가부에 대한 판례와 고용노동부의 행정해석, 중앙행정심판위원회의 입장을 보다 구체적으로 검토하고 그 분석을 시도하였다. 또한 근로자가 부당해고 기간 근로를 제공하였더라면 받을 수 있었던 금품의 법적 성질, 임금 상당액의 법적 성질 및 체당금 지급대상에의 포함 여부, 임금 상당액 이상의 금품(금전보상금)의 법적 성질 및 그것이 체당금 지급대상에 포함되는지의 여부에 대하여 순차적으로 검토하였다. 그리고 첫째, 부당해고를 당한 근로자는 해고기간 근로를 제공하였더라면 받을 수 있었던 임금 전액을 지급받을 수 있고 이는 체당금의 지급대상에 포함된다고 보아야 하며 둘째, 임금 상당액은 임금의 성질을 가지며 체당금 지급대상에 포함되어야 하고 셋째, 임금 상당액 이상의 금품의 법적 성질에 대한 견해의 대립이 있으나 그 논의의 실익은 크지 않다는 결론을 도출하였다. 금일 지방고용노동관서의 장들은 임금 상당액을 대상으로 한 체당금 지급신청에 대하여 계속해서 체당금 확인 부적격통지 내지 체당금지급사유 확인불가통지를 하고 있는바, 임금 상당액의 법적 성질에 비추어 이는 위법·부당한 처분이라 판단된다. 한편 중앙행정심판위원회는 임금 상당액의 법적 성질에 대하여 판단한 바 없는 판례만을 인용할 뿐, 어떠한 추가적인 논거도 제시하지 아니하면서 위 처분에 대한 취소청구를 인용하여 왔는바, 이는 결론에 있어서는 타당하나 그 근거를 결여한 논증이라는 비판으로부터 자유롭기 어렵다. 임금채권보장제도는 임금 등을 지급받지 못하고 퇴직한 근로자의 생활안정에 이바지하는 것을 그 목적으로 하는바, 국가는 임금 상당액의 법적 성질에 대한 기관 간 이견을 조속히 극복하고 지체 없이 이들에 대한 권리구제에 임하여야 할 것이다.

Wage Claim Guarantee System is a system by which the state pays unpaid wages, etc. within a certain range, in place of the business proprietor. The recipient is a worker who retired without receiving their wages, etc. due to the bankruptcy of companies, and asked for the payment of his/her wages payable within a certain period. In such a case, the state exercises the right of the worker in subrogation to claim unpaid wages, etc. against the employer within the amount paid by the state. Meanwhile, an unfair dismissal is invalid in the private law, and precedents stand on the position that a worker may ask for a benefit in return, the payment of wages he or she would have been paid if he or she had offered work during the period of unfair dismissal. Thus, the wrongfully dismissed employee may ask for the confirmation of the invalidity of the dismissal and appeal to recieve his or her unpaid wages. In addition to this means of remedy through the Court, the Labor Standards Act provides a remedy from the Labor Relations Commission (Article 28, Clause 1 of the Labor Standards Act). If the Labor Relations Commission judges that the dismissal is unfair, it shall issue an order of remedy to the employer (Article 30, Clause 1 of the same Act). At this time, if the worker does not desire to be reinstated to his or her former office, instead of issuing an order to reinstate, the commission may order the employer to pay such worker the amount of money or other valuables equivalent to or higher than the amount of wages he or she would have been paid if he or she had offered work during the period of dismissal (The same Article, Clause 3). The problem is that the precedents stand on the position that a worker who was wrongfully dismissed may ask for the payment of ‘wages’. On the other hand, the Labor Relations Commission orders to pay ‘equivalent amount to wages’ (or Money and valuables more than the equivalent amount to wages if he or she does not want the reinstatement) with an order to reinstate him/her in his/her former office as an order for remedy. The Ministry of Employment and Labor and the Administrative Appeals Commission have conflicting positions concerning the legal nature of the ‘equivalent amount to wages’ and whether to acknowledge the unfairly dismissed worker as the due recipient of subrogated payment. Moreover, the gap between these different opinions delays the remedy for the worker who retired without receiving this and applied for the subrogated payment, since his or her former employer didn’t pay the equivalent amount to wages even after the order. This practice does not meet the purpose of the Wage Claim Guarantee Act to contribute to a worker’s stable life by preparing a measure to guarantee the payment to the worker who retired without receiving the payment of wages etc. Thus, this research attempted to analyze the precedents, the administrative interpretation of the Ministry of Employment and Labor and the decision of the Administrative Appeals Commission regarding the legal nature of the equivalent amount to wages and whether the subrogated payment should be given or not. In addition, the legal nature of the money and valuables a wrongfully dismissed worker would have been paid, the legal nature of the equivalent amount to wages and whether it could be covered by the subrogated payment, the legal nature of money and valuables (monetary compensation) more than the equivalent amount to wages and whether it could be covered by the subrogated payment were examined in order. As a result, first, a worker who was wrongfully dismissed could receive the ‘wages’ he/she would have been paid if he or she had offered work during the period of dismissal, which should be covered by the subrogated payment; Second, the equivalent amount to wages has a nature of wages and should be the subject of the subrogated payment; and third, there is a conflict in opinions on the legal nature of money and valuables more than the equivalent amount to wages, but this conflict is not crucial in determining on the subrogated payment. Today, the heads of local Employment and Labor Offices keep notifying that they could not confirm the grounds for payment or that they would not pay because the applicant is not a recipient, concerning an application for the payment of subrogated payment for the equivalent amount to wages. In light of the above reviewed legal nature of the equivalent amount to wages, the disposition is either illegal or unjust. In addition, The Administrative Appeals Commission has affirmed the claim for the cancellation of the above disposition, but the precedents it sited have not judged the legal nature of the equivalent amount to wages. Even though its conclusion is appropriate, it can still be criticized as an argument without grounds. The Wage Claim Guarantee System aims at contributing to the stabilization of the life of workers who retired without receiving their wages, etc., so the state should overcome different opinions between institutions concerning the legal nature of the equivalent amount to wages, as soon as possible and engage in the remedy without delay.
