본고에서는 16세기 소송(訴訟) 관련 문서에서 확인되는 한 여성의 목소리를 통해, 노비들 역시 당시의 법과 관행을 적극 이용하면서 자신의 삶을 보다 안전하게 영위하고자 노력한 행위주체였음을 살펴보고자한다. 경주부(慶州府) 안강(安康)에 살던 반춘(班春) 또는 다물사리(多勿沙里)라고 불리던 한 여성과 그녀의 가족은 노주(奴主)의 침학(侵虐)에서 벗어나고자 도망을 선택했지만, 결국 안정적 삶을 꾸리지 못한 채 대부분 사망하였다. 그녀는 이후 비교적 경제적 기반을 갖춘 시노(寺奴)와 혼인한 뒤, 자식을 낳아 기르며 삶을 유지해 갔다. 하지만 당시 도망노비들은 끊임없이 추쇄(推刷)와 횡탈(橫奪)의 대상이 되었고, 때로 이들은 양반·권세가로의 투탁을 선택하기도 했다. 한편, 당시 호강인(豪强人)들은 양천미변(良賤未辨), 도망유루(逃亡遺漏), 양처병산(良妻倂産) 등 다양한 명목으로 이들을 자신의 소유노비로 확보하고자 했고, 이를 위해 각종 문서위조나 소송 등도 마다하지 않았다. 이에 노비들 역시 송정(訟庭)에서의 기만과 조작을 통해 소송을 자신에게 보다 유리한 쪽으로 이끌고자 노력하였다.

Written judgments from the Joseon Dynasty are very useful resources for understanding the full accounts of events in that they thoroughly record the process of litigation. Tracing the litigation process through the written judgment, it can be observed that the basis of an argument from either side of the plaintiff or the defendant sometimes weakens. In other times, efforts to lead the litigation in one’s favorable way by often turning over the previous arguments or submitting other evidence can be seen. The written judgment from the time thus becomes an valuable resource. This paper attempts to shed light on the fact that the slaves were also a main body that actively used the laws and customs at the time for the purpose of leading a safer life, by examining the voice of a female that is contained in a litigation document from the 16th century.
