칼 슈미트의 『토마스 홉스의 국가론에서의 리바이어던』(1938)은 그의 나치 협력 이전 이론으로의 복귀로 평가되곤 한다. 본 논문은 이에 대한 분석을통해 그의 기본 이론이 이미 독재 및 나치와의 협력 가능성을 내포하고 있었음을 밝히고, 아울러 홉스 정치철학의 현재적 의미를 되살리고자 한다. 이 저서에서 슈미트는 무엇보다 거대한 국가 기계를 상징하는 홉스의 리바이어던이 그의 개인주의적 요소들 때문에 실패했다고 평가한다. 슈미트가 거론하는 개인주의적 요소들은 원자화된 개별자들의 다원주의적 자연 상태, 무정부주의적 사회계약, 종교적 판단 및 법률적 사유의 사적 자유 영역 인정 등이다. 이 때문에 주권적 결단이 중요시되는 홉스의 국가는 간접 권력들의 무정부가능성을 극복하지 못한다는 것이다. 슈미트의 이러한 비판은 자신이 구상한권위 있는 결단을 독점하는 주권자 중심의 총체국가에 그 궁극 의도가 있다. 그러나 홉스의 국가론은 극단적 개인주의가 극단적 전체주의와 하나의체계를 이루고 있는 것으로 보아야 한다. 그의 자연 상태는 생존권 보장이 없는 만인의 투쟁을 절대적 자연권으로 인정한 것으로서 국가 형성 이후에도 저항권으로서의 가능성을 지니고 있다. 더구나 군주의 권위(authority)은 본인(author)인 백성들의 자연권을 기계적으로 실현하리라는 낙관주의에 기반을 두고 있다. 슈미트는 개인주의가 극단화될 때 초래될 수 있는 전체주의의 위험을위험으로 보지 않으며 오히려 국가 총체성의 확보를 위해 내면의 자유까지도흡수하는 개인주의와 자유주의의 절멸을 원한다. 이 때문에 그는 홉스에게서권위의 기원에 대해 묻지 않으며, 어떠한 상황에서도 결코 철회될 수 없는 만인의 절대적 자연권 즉 인권의 기초에 대해 언급하지 않는다.
Carl Schmitt` The Leviathan in the State Theory of Thomas Hobbes(1938) is now and then regarded as his return to theoretical positions before his cooperation with Nazis. This paper tries to reveal per analysis of the treatise that his foundational theory already implies the possibility of cooperation with dictatorship or Nazis, and to revive the presentive meaning of Hobbes` political philosophy. In the treatise Schmitt estimates above all that Hobbes` Leviathan as symbol of huge machine-state failed because of his individualistic elements, for instance, the pluralistic state of nature out of atomized individuals, the anarchist covenant, the recognition of private liberty for religious judgement and juristic thinking. On this account Hobbes` commonwealth, in which the sovereign decision is of key importance, is nevertheless not able to overcome the possibility of anarchy from indirect powers. This criticism of Schmitt intends ultimately to conceptualize the total state, in which the sovereign monopolizes authorized decisions. But the state theory of Hobbes should be considered as one system of radical individualism with radical totalitarianism. According to him, in the state of nature is the struggle as the absolute right of nature recognized to everyone without guarantee of safe life. Thus, there is always room for the right of resistance after construction of state. Besides, his state theory is based on optimism, in that the authority of prince realizes automatically the natural rights of subjects as authors. Schmitt does not count as danger the totalism, which could be brought about from the extremization of individualism, but longs rather for complete extermination of individualism and liberalism inclusive of inner freedom, in oder to establish the totality of state. Therefore, he neither asks Hobbes about the origin of authority, nor mentions the foundation of human right as absolute right of nature given to everyone, which is never in any situations revocable.
