공정거래위원회가 담합에 대해 조사하는 경우 해당 기업에 대해 과징금을 부과한다. 이후에 과징금이 부과된 기업들에 대해 검찰의 기소에 따른 형사처벌 뿐만 아니라 발주기관의 손해배상 청구까지 이어지고 있으며, 이러한 제재들을 감수해야 하는 기업들은 삼중처벌이라는 문제를 제기하고 있다. 그러나 이와는 달리 최근 발생한 일련의 담합행위와 관련하여 공정거래위원회의 과징금 부과가 독점규제 및 공정거래에 관한 법률(이하 ``공정거래법``이라 한다) 위반행위에 대한 제재수단으로 충분한가에 대한 논의도 제기되고 있다. 이러한 논의는 빈번하게 발생하는 공정거래법 위반행위에 대한 법집행이 그동안 주로 공정거래위원회에 의한 행정집행을 중심으로 이루어지면서 행정집행만으로는 공정거래법위반을 예방·억제하기에 부족하다는 비판이 제기되면서 시작된 것이다. 이에 공정거래위반행위를 억제하기 위해 형사제재가 필요하다는 주장이 제기되었고, 피해자 구제에 만점을 기하면서도 억제력을 발휘할 수 있는 민사적 구제수단을 확충하는 방식으로 행정집행의 부족을 보완할 필요가 있기 때문에 집단소송제도와 징벌적 손해배상제도 등을 도입해야 한다는 주장도 제기되었다. 이에 본 논고에서는 우선 공정거래위반행위와 그 처리현황을 분석하고 분석결과를 토대로 형사적·민사적 제재가 필요한가에 대해 검토한다.
