원격대학원은 고등교육법에 근거하여 인가 및 운영되고 있으나 관련 법령의 체계와 내용이 취약한 형편이다. 본 연구는 원격교육이 급속히 확산되고 있는 이 때 원격대학원에 관한 법령을 정비하는데 필요한 구체적인 시사점을 제공함으로써 원격대학원이 명확한 법제도 위에 운영될 수 있는 근거를 마련하고, 아울러 현재 원격대학원을 포함하여 교육인적자원부에서 추진 중인 고등교육법에 관한 원격교육 관련 법령의 개정 작업에 기여하고자 하는데 목적이 있다. 이를 위해 본 연구에서는 원격대학원에 관한 선행연구 및 관련 국내외 문헌들을 분석하고 시사점을 도출한 후 이를 바탕으로 원격대학원과 관련하여 현행 고등교육 법령이 안고 있는 문제점을 분석하고 법령 개정을 위한 구체적인 시사점을 제시하였다. 이를 위해 먼저, 원격대학원 관련 선행연구 및 해외 사례 분석을 통해 원격대학원 관련 법 개정에 필요한 시사점을 도출하였다. 그 다음 현행 원격대학원 관련 법령의 문제점을 분석하였다. 문제점 분석 결과 고등교육법에 나타난 ‘방송통신대학’ 관련 조항의 학위 수여 범위의 부적절성, 고등교육법에서 명시하고 있는 ‘수업의 형태’의 모호성, 원격대학원의 특수성을 반영하지 못하는 ‘대학원 종류’ 관련 규정의 문제, 원격대학원 인가 기준의 법적 근거 취약, 원격대학원 질관리에 관한 규정 미비 등을 지적하였다. 이러한 문제점에 대한 개선 방안으로서 본 연구에서는 고등교육법의 방송통신 대학 규정을 원격대학에 관한 규정으로 개정하며, 원격대학의 학위 취득 관련 규정에 석사학위를 포함시키고, 고등교육법시행령의 특수대학원 규정 및 원격대학원 질관리를 위한 규정을 보완하고, 원격대학원 인가 기준을 강화하는 방안을 제시하였다.

The online graduate programs are authorized and managed under the Higher Education Act. In light of the distance education issue, the law has many flaws, resulting in vague and inefficient enforcement. The purpose of the study was to suggest revisions to improve the current laws and regulations with regard to the online graduate programs. To achieve the research goal, we reviewed the previous research, and related literature, including government reports, related to the online graduate program, and from the literature review, we drew some useful implications to revise the current laws and regulations. With the implications, we suggested possible ways of improving the current Higher Education Act and regulations. The major results of the study were summarized as two folds. First, I founded that the current law and regulations involved a variety of problems such as vague expressions of ‘kinds of instruction’, the inappropriate scope of ‘telecommunication university’ diploma, lack of regulations for the accreditation, and ignorance of differences between traditional education and distance education. In fact, these problems might affect the quality of education among the online graduate programs badly. Second, we suggested revisions on the structure of the related laws and regulations and proposed some ideas about the article revisions especially in the Higher Education Act, so that policy makers might use the idea as they revised the law for an amendment. The suggestions included the term change from the ‘telecommunication university’ to the ‘distance university’, the evaluation of the online graduate program, the revision of the accreditation criteria, and the establishment of Distance Education Support Center in the『Higher Education Act』.
