식품위생법상 허위표시, 과장광고의 기준을 명확히 하기 위하여 그 규정의 연혁을 살펴보았고, 허위표시 및 과장광고로 인정된 판결과 부정된 판결을 검토하여 어떤 경우에 허위표시, 과장광고에 해당하는지 분석하였다. 식품위생법은 초기에는 허위표시만 금지하였다가 식품에 관한 올바른 정보제공을 위하여몇 차례 개정을 통해 허위표시 외에도 과장광고, 비방까지도 모두 금지하도록하였다. 식품위생법상 허위표시, 과장광고에 대하여 이를 직접 다룬 논문은 없고 주로 위 개념과 기준은 판결을 통하여 축적되고 있다. 헌법재판소 및 대법원 판결을 분석한 결과, 사회 일반인의 평균적인 인식을 기준으로 사회일반인이 흔히 접하는 식품의 경우에는 의약품으로 혼동할 우려가 없어 무죄를 선고한 반면, 자주 접하지 않는 식품의 경우에는 의약품으로 혼동할 우려가 있다고 하여 유죄를 선고하는 것으로 분석되었다. 따라서, 사회일반인의 시각을 객관화하기 위하여 좀 더 다양한 사례를 통한 판결의 축적으로 이를 정리할 수 있을 것이다. 본 자료가 식품위생법을 비롯한 식품관련 법제의 허위표시, 과장광고에 대한 논의의 출발을 위한 기초자료로 사용될 수 있을 것이다.
