전속고발제도는 1981년 도입 당시부터 폐지 논란의 대상이 되어 왔다. 이에 2013년 6월 25일 개정된 공정거래법에서는 제71조의 전속고발제도와 관련하여 기존에 공정거래위원회에 대한 고발요청권을 보유하고 있는 검찰총장 이외에 감사원장, 조달청장, 중소기업청장에게도 고발요청권을 추가적으로 부여하고 이들의 고발요청이 있는 경우 공정거래위원회가 고발의무를 지도록 하고 있다. 그러나 위 개정법이 공정거래위원회의 전속고발권을 약화시켰다 하더라도, 공정거래법상의 자진신고자 감면제도, 고소불가분의 원칙의 부적용, 동의의결제도의 도입에 비추어 볼 때 공정거래위원회의 고발권 행사에 관한 권한은 여전히 막강하다고 볼 수 있다. 그렇다면 전속고발제도와 관련한 논쟁은 여전히 현재진행형이다. 이에 공정거래법상 전속고발제도의 존폐논의를 검토해 보았으나, 전속고발제도는 필요한 제도라고 생각한다. 전속고발제도를 폐지하지 않는다면, 전속고발제도의 개선방안 모색이 필요하다. 전속고발권 행사범위를 정확히 획정해야 한다. 그리고 피해자가 고발권 불행사에 대해 다툴 수 있어야 한다. 고발요청권자 확대에 따른 혼란을 방지하기 위해, 고발심사위원회 등 관계기관 간 상호협력 체계를 갖추는 것도 필요하다.
The Monopoly Regulation and Fair Act gave the Fair Trade Commission exclusive complaint right that was on dispute so far since introduction in 1981. On June 25, 2013, the National Assembly revised the law to expand request of the complaint on illegal cartel. Although revision on Antitrust law, I think exclusive complaint right of the Fair Trade Commission didn``t damaged, because of so called ``Consent Order`` ``Leniency`` and so on. Therefore, dispute on the exclusive complaint system was ongoing. This study investigated to reexamine abolition of the exclusive complaint right. And It is reasonable not to abolish the exclusive complaint system. If the exclusive complaint system is not abolished, It is necessary to improve this system. In the first place, it is desirable to make more narrow the categories of criminal offenses under exclusive complaint system. because the Korean Fair Trade Commission has accused few case so that the criminal provision under Fair Trade Act has not worked effectively to deter the offenses. Class action and the punitive damage system should be also legislated. and then, we should think about granting right to request for accusation to victims. Cooperation between the Fair Trade Committee and the organs concerned including the Prosecution is required more than ever to enforce the revised Fair Trade Act appropriately. It is urgent for the Fair Trade Committee to establish a new division to discuss about complaint.
