이 글은 지난 10여 년간 중대한 변화 속에 있는 유엔에서의 북한인권 논의의 내용을 법률 정책적 측면에서 분석하고, 우리의 입장에서 북한 인권 개선을 위해 취하여야 할 법률 정책적 대안들을 검토하는 것을 내용으로 한다. 2014년 이후 북한 인권 개선 논의의 공통된 출발점은 2013년의 COI보고서와 동보고서를 중심으로 작성된 북한인권 특별보고관의 보고서들, 인권이사회, 총회 및 안전보장이사회의 총의(consensus)등이다. 총의의 내용은 다음의 내용을 포함한다. 첫째로, 북한 내부의 인권침해 상황은 인도에 반한 죄에 해당하며, 책임자들은 국제형사법에 근거하여 형사책임을 부담한다. 둘째로, 모든 북한인권 개선 전략은 “인권 우선 전략 (Rights up front)”의 기조하에 피해자 중심이 되어야 하며, 진실의 발견, 법적 책임의 처리, 피해자의 구제등이 핵심적인 내용이 되어야 한다. 셋째로, 북한인권문제의 해결은 보호책임에 근거하여 국제사회의 책임의 대상이므로 유엔 회원국들 전체가 인도에 반한 죄에 대한보편적 관할권의 적용 등 구체적인 법률정책들을 마련하고 시행하여야 할 것이다. 보고서 이후 2년여의 시간이 지났음에도 본질적인 상황의 변화가 보이지 않는다는 비관적 전망에도 불구하고, 우리는 향후에도 지속적으로 북한인권조사위원회 보고서의 다양한 내용의 결론들과 권고들을 우리의 맥락에 맞추어 새로운 북한인권 전략들을 마련해야 한다.

The year of 2014 marks as a drastic turning point in the discussion on the North Korean human rights. After decades of silence and politicization within the UN system, the issue of NKHR has finally earned a momentum of its own placing itself as one of the items in the docket of the UN machinery that require most urgent and concerted efforts to redress. The findings of the COI have established a consensus, in particular, that the crimes gainst humanity have been committed in the DPRK; the perpetrators, including those in the top decision-making line, should be held accountable possibly in the form of criminal persecution; the international community should act based upon the responsibility to protect the residents in the DPRK. This writing seeks to analyse the legal implications of the recent consensus on the HR situations in the DPRK within the UN system and the process thorough which such a historic agreement has been made. In conclusion, it proposes a set of both legal and policy recommendations for the future course action in the endeavor possibly to bring a fundamental change on the situation of human rights in the DPRK.
