이 연구는 성폭력범죄 중에서 강제추행죄의 양형결정요인을 판결문 기록조사를 통하여 경험적으로 분석하고자 한다. 형법 제51조에서는 범죄와 관련된 다양한 요인, 즉 행위과정 및 결과, 행위자, 피해자, 범행 이후 정황 등을 고려하여 양형을 결정할 것을 규정하고 있다. 이 연구에서는 강제추행죄 양형결정과정에서 법관들이 형법 등에서 열거한 각각의 양형요인들을 어느 정도 고려하고 있는지, 어떤 영역을 더 중요한 요인으로 고려하는지 등을 분석하고자 한다. 이 연구에서 분석된 자료는 판결문 기록이며, 1심 판결일자를 기준으로 2012년 6월 1일부터 2014년 6월 30일에 양형기준제도에 해당하는 강제추행죄 사건 중에서 995건을 분석대상으로 삼았다. 강제추행죄의 양형현황은 선고형량, 집행유예/실형, 실형량으로 구분하여 분석하였다. 분석결과, 강제추행죄의 선고형량의 결정에서는 피해자 요인이 가장 중요한 영향을 미치는 것으로 나타났으며, 그 다음으로는 상해 여부와 같은 행위결과가 중요한 영향을 미치는 것으로 분석되었다. 그러나 실형량에 대한 분석에서는 범죄행위요인과 피고인의 사회적 유대관계 등의 요인들이 중요한 결정요인으로 나타났다. 강제추행죄의 양형결정에서 추행의 행위요인은 선고 형량이나 실형량에 중요한 요인으로 나타났지만, 선고형량의 결정에서는 상대적으로 피해자 요인이 더 반영되고, 집행유예 및 실형량의 결정에서는 피고인 요인과 범행 후의 정황요인이 상대적으로 더 반영되는 것으로 분석되었다. 이러한 결과는 강제추행죄의 양형결정에서 법관들은 다른 요인을 고려하여 선고형량 및 실형량을 결정한다는 것을 시사한다.
The purpose of this article is to investigate the effect of sentencing factors on sentencing in sexual molestation, indecent act by force/compulsion. The sentencing factors of sexual molestation were measured with a scale of four dimensions: offence aspects and results, offender factors, victim factors, and post-crime circumstance. Also, sentence aspects were measured with sentence length, in-out decision(probation/incarceration), and imprisonment length. The data analysed in this study were derived from sentencing in court of first instance in Korea, kept as files in Prosecutorial Guideline System(PGS) of the Supreme Prosecutor’s Office. The data consist of a total of 995 cases in sexual molestation sentenced between June 1, 2012 and June 30, 2014. Multiple regression analysis and Logistic regression analysis have been used. The results revealed that sentencing factors that affect sentence length and imprisonment length are different respectively, although offence factors are of primary importance. The results indicated that victim factors and offence aspects have significant impacts on sentence length. Also, offender factors such as criminal``s social bonding and victim-criminal agreement have significant effects on in-out decision(probation/incarceration) and imprisonment length in sexual molestation crime.
