개인정보는 개인적, 사회적, 경제적인 중요한 자산이지만 동시에 개인의 인권과 중요한 관련이 있는 정보이다. 클라우드 서비스를 비롯하여 정보통신의 확대 및 활성화 환경에서 개인정보의 중요성이 더욱 강조되고 있지만, 정보통신 환경의 편의성이 증진됨에 따라 개인정보의 침해 가능성은 오히려 확대되었다고 보인다. 특히 클라우드 서비스에서는 국외로 이동된 개인정보의 명확한 위치를 확인하기 쉽지 않고, 가상화 및 분산화 기술로 인하여 개인정보의 저장위치가 실시간으로 변경되기도 하는 등 클라우드 서비스에서의 개인정보의 국외 이동 양상은 더욱 복잡하다. 따라서 클라우드 서비스의 이용으로 인하여 국외로 이동된 개인정보에 대해서 어느 국가의 법을 적용할 것인지를 판단하기 쉽지 않다. 그러므로 클라우드 서비스의 데이터센터에 저장된 개인정보에 대해서는 도착국, 개인정보가 이동되어 도착하는 국가의 법을 적용하기보다는 출발국, 즉개인정보가 시작되는 국가, 다시 말하면 정보주체가 기원하는 소속국가나 경우에 따라서는 정보주체의 거주지 국가의 법을 적용할 수 있는 근거를 마련하는 것이 필요할 것으로 보인다. 요컨대 클라우드 서비스의 데이터센터에 개인정보가 저장되는 경우, 개인정보가 어느 데이터센터에 저장되어 있는지, 해당데이터센터가 어느 국가 내에 위치하는 지 등을 확인하기 쉽지 않기 때문에, 클라우드 서비스의 데이터센터에 저장됨으로써 국외로 이동한 개인정보에 국내법을 적용할 수 있도록 역외적용 규정을 둘 경우 개인정보의 보호에 보다 안전한 법적 장치가 될 것으로 보이며, 클라우드 서비스에서 국외로 이동된 개인정보에 어느 국가법을 적용할 것인지의 문제를 해결할 수 있는 방안이 될것으로 보인다.

Cloud computing can be defined as a new computing paradigm which gives users ubiquitous access to computing resources, such as networks, servers, storage and applications through the Internet, and lets users enjoy immediate and convenient cloud services according to their needs. A cloud service functions based on key technologies such as virtualization and decentralization. While virtualization and decentralization allow the cloud service to supply an ubiquitous, low cost, and stable service, data stored in cloud data centers move from one data center to another. With various data, personal data can be transferred abroad and, therefore, personal data transferred abroad may not be protected under domestic laws and infringed because countries have various laws regarding personal data. Due to characteristics of cloud computing, it is not easy or even impossible to determine which country’s rule should be applied to the personal data transferred abroad. Therefore, extraterritorial application rules of personal data protection rules are needed to protect personal data of domestic juristic persons.
