보험계약은 청약과 승낙이라는 의사표시의 합치에 의하여 성립하고, 구체적인 계약의 내용은 보험약관에 규정되어 있다. 따라서 보험계약의 성립 단계에서는 계약의 일반 해석법리가 적용된다. 한편 보험계약의 내용인 보험약관은 보험자에 의하여 일방적으로 작성되는 점을 고려하여 엄격한 약관의 통제를 따르게 된다. 그런데 보험자에 의한 명백한 약관 작성의 오류가 있는 경우 계약에 의한 해석론을 건너뛰고 약관의 해석통제에만 따르게 되는 경우 여러 부작용이 발생할 수 있다. 따라서 보험계약 및 보험약관과 관련하여 발생한 분쟁을 합리적으로 해결하기 위해서는 계약의 해석론을 포함하여 보험약관에 대한 해석론을 적용하여야 한다. 보험사고는 기본적으로 우연한 사고를 전제로 한다. 이러한 점을 반영하여 우리 상법은 고의에 의한 사고를 면책사유로 규정하고 있다. 자살은 고의한 사고임에도 불구하고 유족보호의 관점에서 보험가입 후 2년이 지난 자살에 대해서는 일반사망보험금을 지급하고 있는 것이다. 그런데 보험자의 잘못된 약관작성으로 그리고 이를 뒷받침하는 대법원의 판결에 의해 우리나라에서는 자살에 대한 융성한 대접이 가능해졌다. 이러한 결과는 결코 사회적으로 바람직한 것이 아니다.

Insurance is basically the premise of an accident. Business Commercial Code in Korea stipulates that accidents caused by intentional are not indemnified. But, the insured commits suicide, the proceeds are payable to the beneficiaries. After two-years has passed. By the way in the case of the intent suicide, beneficiaries can receive accidental death benefit. This result is not proper from a social perspective.
