본 연구에서는 중앙정부의 갈등 예방 관련 법률의 입법이 부재한 상황에서 기초 지방정부가 지역 사회의 갈등 문제에 적극적으로 대처하기 위한 자율적인 조례의 채택 과정을 혁신 정책의 확산 과정으로 이해하여 확산 추동 요인을 실증적으로 분석해 보고자 하였다. 이를 위해 로짓 분석 결과를 토대로 독립변수 변화와 이들 독립 변수의 결합 조건에 따른 갈등 조례의 채택의 확률을 추정하였다. 분석 결과, 기초 지방정부의 정치ㆍ행정적 요인과 같은 지역 내부적 요인보다는 지역적 효과와 수직적 확산 메커니즘과 같은 외부적 요인과 정책 특성적 요인으로서 갈등 예방 정책의 기능적 수요인 공공분쟁 발생 변수 등이 갈등예방 조례의 확산 과정에서 중요한 역할을 하는 것으로 나타났다. 이러한 결과는 지방자치단체가 지역사회에서 경험한 공공갈등 발생에 따른 자발적인 대응으로서 갈등관리 조례를 제정하는 측면과 동시에 상위 정부의 제정여부나 주변 지자체의 도입이라는 외부적 여건에 주로 영향을 받아 정책을 채택하는 정책의 확산 과정이 작동하고 있다는 정책적 시사점을 지닌다. 다만 추가적으로, 지방정부 혁신성 지수는 보다 체계적인측정이 필요하고 갈등 예방 조례 도입 과정에 대한 심층적인 사례 분석이 보완될 필요가 있다.

The purpose of this study is to identify factors that influence the diffusion of conflict prevention ordinance by local government, in that its adopting process would be understood as a diffusion of innovation policy in the situation of not an law and regulation regarding conflict prevention in the central government level. With the result of logit analysis, we estimate the adoption probability of conflict prevention ordinance by local government according to the change of independent factors and their coupling condition. The results indicate that external factors like regional effect and vertical diffusion mechanism as well as policy’s characteristics triggering functional demand play a more important role compared with the internal factors such as political·administrative factors of local government. These findings implicate that basic local governments adopt conflict prevention ordinance voluntarily against public conflicts in their territory on the one hand, and they are influenced externally not only by adoption of upper(regional) government but also neighboring local governments one the other hand. For the further study, there needs a more systematic measurement for the innovation index in the local government level and a deeper case analysis for adoption process of the conflict prevention ordinance by local government.
