헌법 제31조 제4항은 대학의 자율성을 명문으로 보장하고 있는데도 불구하고 교육행정당국의 규제 앞에 늘 무기력하였고, 사법적 판단을 통해 대학의 자율성이 보호된사례도 많지 않았다. 대상결정은 획일적이고 권위적인 교육행정에 일침을 가하여 대학자율권의 규범력을 일부라도 회복시켰다는 점에 그 의의가 있다. 헌법재판소는 종래부터 국·공립대학교를 실체법상 대학자율권의 주체로 인정하여 왔었지만, 이번 결정에서는 한 걸음 더 나아가 국립대학에게 독자적인 헌법소원 청구인능력을 인정하였다는 점에서 소송법적 의의가 크다. 그러나 이에 관한 최초의 결정이면서도 논거의 제시는 물론, 명시적으로 판단조차 하지 않았다는 점은 아쉽다. 이번결정을 계기로 국·공립대학에 대하여 단순히 영조물이 아니라 대학자율권 등의 관련권리를 독자적으로 보호받을 수 있는 법적 지위를 설정해 주는 이론적 논의가 이어지기를 기대한다. 나아가 공교육체계에서 국·공립대학과 유사한 공적 과제를 부여받고있는 사립대학에 대해서도 독자적인 소송법적 지위를 인정하는 것이 필요한지, 가능한지의 고민도 필요해 보인다. 법률유보원칙 위반 여부에 관하여는, 인가와 관련하여 국립대학에 대하여 학생모집정지처분을 내릴 별도의 법률적 근거가 없는데도 불구하고 교육행정청의 일반적 권한조항을 내세워 법률유보원칙에 위배되지 않는다고 판단하고 말았다. 헌법재판소는 법률유보원칙을 제대로 적용함으로써 교육행정청의 자의적인 권한행사의 소지를 줄이고, 의회유보원칙 및 교육제도법정주의의 정신에 따라 교육에 관한 민주적 통제를 복원하여야 할 것이다.
Although paragraph 4 Article 31 of Constitution guarantees academic autonomy of university, that autonomy has been constantly encroached by educational administrative agencies, and effective judiciary remedy was seldom provided. The decision of the Constitutional Court herein reviewed recovered the autonomy of a national university against the unreasonable and authoritative sanctions from educational administrative agency. The Constitutional Court has been so far acknowledged constitutional right of academic autonomy for national university. This decision further endowed national university with the capacity to sue in the process of constitutional complaint for the first time. But the endowment was done implicitly, with no ground given. National university is more than mere public facility as far as academic autonomy is concerned. Substantive rights concerning academic activities of national university should be protected, and proper procedural capacity need to be acknowledged in that regard. Although no individual statutory ground for the sanctions against the university could be found, the Court did not see any violation of the principle of statutory reservation, on the basis of general authorization that empowered the educational administrative agency to supervise and direct university. This is far from constraining the tendency of educational administrative agency toward arbitrary exercise of its power.
