본 논문은 카톨릭 보수주의자이며 독일 나치즘에 가담하기도 했던 법학자 칼 슈미트와 유태계 철학자이자 나치즘의 박해 속에 죽어간 발터벤야민이 예외상태론에 대해 남긴 논쟁들을 추적하여, 예외상태가 현대 정치의 존재론적 조건이자 한계개념임을 밝혀내고 그것의 정치철학적 함의를 제시하는 것을 목적으로 한다. 나아가 주권권력이 선포하는 예외상태가 곧 역예외상태를 초래하여 주권권력 자체를 위협하는 역설적 상황이 전개될 가능성 역시 예외상태 개념 속에 내포돼 있음이 밝혀질 것이다. 이와 같은 논의는 결국 현대 민주주의가 갖는 취약성과 한계를 고찰한다는 점에서, 민주주의의 미래를 둘러싼 논쟁에 유의미한 교훈을 제공해줄 것이다.
The purpose of this article is to expose the state of emergency as an ontological condition for the modern politics and as its border concept, and to illustrate its philosophical implications by tracing the controversies on the state of emergency between Carl Schmitt and Walter Benjamin. Furthermore, it will be discovered that the state of emergency which is declared by sovereign power causes the counter-state of emergency and can threaten the sovereign power itself. This possiblity of the paradoxical situation is included in the notion of the state of emergency. Thus, this debate considers the weaknesses and limits of modern democracy, and in this sense, it would give us significant perspectives about its future.
