균등론 제1요건(과제해결원리 동일성 요건)과 관련하여 대법원은, “출원당시의 공지기술 등을 참작하여”라고 판시하여 제1요건 판단 시 명세서 외 공지기술의 참작을 인정하는 것으로 보이지만 그 판시만으로 구체적 참작방법을 알기는 어렵다. 이 글에서는 이 문제에 대한 일본의 논의를 살펴본 다음, 관련 대법원 및 하급심 판결례를 분석한 후, 이러한 검토와 분석을 토대로 ① 명세서 외 공지기술을 제1요건에서 참작하는 것의 당부 및 ② 명세서 외 공지기술을 참작할 경우 구체적으로 어떻게 참작하는 것이 바람직한지 검토해 보았다. 우선 균등 판단에 있어 명세서 외 공지기술이 참작되어야 함은 분명하다. 다만, 명세서 외 공지기술이 제1요건 판단에서 고려되는 것에 대해 긍정설과 부정설이 있는데, 예측가능성이라는 면에서 부정설의 장점도 인정되지만 긍정설의 경우에도 합리적 참작방법 정립을 통해 예측가능성에 대한 우려를 해소하면서도 판단의 유연성이라는 장점을 살릴 수 있을 것으로 보인다. 종래 대법원 판시가 긍정설의 입장에 선 것이라면 명세서 외 공지기술의 구체적 참작방법이 향후 대법원 판결을 통해 제시되는 것이 바람직할 것이고, 만일 그렇지 않다면 향후 대법원 판결을 통해 그러한 점을 분명히 할 필요가 있다고 생각된다. 한편, 제1요건 판단에 있어 명세서 외 공지기술의 참작이 인정되는 경우 그 참작방법을 구체화하여 실무에서의 혼란을 해소할 필요가 있다. 여기에서 중요한 점은 명세서 외 공지기술의 역할은 문언의 범위를 넘어 인정되는 구성요소의 균등 범위의 폭을 정하는 데 참작되는 것일 뿐이라는 점이다. 따라서 명세서의 기재(명세서 기재 종래기술 포함)에 기초하여 특허발명의 과제와 해당 과제를 해결하기 위해 균등 여부가 문제된 구성(c1)이 기능하는 원리를 파악하되, 구성 c1이 문언의 범위를 넘어 대응구성 c2까지 포섭할 수 있을 정도로 상위개념화 또는 일반화가 가능한지 검토함에 있어 명세서 외 공지기술이 참작되는 것이고, 이 경우 명세서 외 공지기술을 가지고 특허발명의 해결과제나 과제해결수단을 변경하는 것은 허용될 수 없음을 분명히 할 필요가 있다.
The first requirement of the Doctrine of Equivalents (hereinafter `DOE`) is that the solution of the accused embodiment must be regarded as a solution equivalent in value to the solution of the claimed invention (hereinafter `solution equivalent in value` test). Then, is it allowed to use prior arts not described in the specification when determining whether the deviating solution be regarded as equivalent in value to the claimed solution? If yes, how to use? This article considers these questions, based on the comparative study and case analysis. Both pros and cons exist on the first question. The pro argument is based on technical value judgement according to objective considerations. In contrast, the con argument is based on predictability and thus, prior arts should be considered under the fourth requirement of DOE (so-called "practicing the prior art" defense). Although the con argument is persuasive in view of predictability, the pro argument is more persuasive for the reasons as follow. Firstly, use of prior arts is more flexible in the first requirement than in the fourth requirement. Secondly, any concern on the predictability can be mitigated by reasonable use of prior arts under the `solution equivalent in value` test. Two things must be clarified by the Supreme Court of Korea. According to Supreme Court decisions, the equivalence between the deviating solution and the claimed solution should be determined in light of the specification and "the prior arts." Does this mean that prior arts not described in the specification may be used in this analysis? Next, if yes, what is the reasonable way to use prior arts under the `solution equivalent in value` test? This article suggests as follows: Firstly, prior arts not described in the specification must be used to construe the value of the claimed solution so narrowly as to negate the first requirement. Next, the first requirement of DOE is met where the modified feature of the accused embodiment can be regarded as a realization of a more generic teaching that could be recognized by the skilled person in view of the specification and the prior arts. Therefore, prior arts not described in the specification must be used in order to define such generic teaching. They should not be used to change the problem or solution of a patented invention.
