현 정부는 2013년 출범 직후부터 창조경제 활성화라는 정책 기조 하에 ICT 융합 산업 진흥을 위해 노력해 왔다. 입법적 측면에서, 2013년 8월 13일 제정된 정보통신 진흥 및 융합 활성화 등에 관한 특별법 은정부의 ICT 융합을 주축으로 하는 신산업을 육성 정책 등을 뒷받침하기 위한 취지를 가지는 법률로서 기능하고 있다. 이에 이 논문은 동법의 이행상황에 대한 평가를 중심으로 하여, 향후 현행 ICT 융합 법제의 개선 방향과 가능성을 타진해 보는 데 초점을 둔다. 이 법은 현행 ICT 산업 영역의 정책 및 규제 조정에 초점을 맞추고 있는 것으로, 궁극적으로는 국가적 차원의 현행 ICT 규제가 융합 신산업 진흥에 걸림돌이 되고 있다는 인식에 기반하고 있다. 그러나 실제적으로 이 법은 ICT 신성장 산업 육성이라는 실제 법안의 본래 취지와 내용에 기반하기보다는 다분히 임시방편적인 소관 부처의 이해관계를 반영한 결과에서 비롯된 것이었다고 평가할 수 있다. 결론적으로 이 논문은 이상과 같은 문제 지점을 명확히 하고, 규제개선 업무 수행에 있어 부처간 실질적 협력을 추구하는 거버넌스 정립을 주축으로 한 동법의 실무적 차원의 개정 방안을 제시하였다.

The present government has been striving to promote the ICT convergence industry right after its launch in 2013 under the policy of revitalizing the creative economy. In the legislative point of view, “The Special Act on Promotion of Information and Communication Technology, Vitalization of Convergence(Special Act on ICT)“, enacted on August 13, 2013, functions as a law to foster new industries based on the government`s ICT convergence. And this article focuses on evaluating the implementation status of this act and tries to find future solutions and possibilities of the current ICT convergence legislation. This act focuses on the policy and regulatory coordination of the current ICT industry sector, and ultimately it is based on the recognition that current ICT regulations at the national level are obstacles to the promotion of new industries. However, this act can be actually interpreted that its main contents concentrates on the result of reflecting the interest of the department in charge rather than on the original purpose and content of legislation. In conclusion, this article clarifies the above-mentioned problems and suggests the practical revision of this act, which is based on the establishment of governance that seeks practical cooperation among the departments of government.
