오늘날 국제사회는 지속적으로 무역자유화와 국가규제의 관계에 대해 지속적으로 논의를 진행하고 있다. 개도국들은 국제적인 무역체계와 자신들의 국내 정책의 수립을 위한 교섭력에 관해 의문을 제기하기도 한다. 각 국가들은 그들 각각의 사회에 가장 잘 부합하는 장치를 마련할 필요가 있기 때문에 어느 정도의 자율성 내지 탄력성이 보장될 필요가 있고, 아울러서 지구촌 공동의 번영도 함께 고려해야 하는 과제를 가지고 있다. 궁극적으로 국제사회가 추구하는 국제거래의 목표를 달성할 수 있는 보편적인 규범체계의 마련이 중요한 과제가 될 것이다. 상품에 대한 공정 및 생산방법(PPMs)은 그러한 활동의 환경영향에 중요한 요인이 될 것이다. 국제사회는 환경에 지속가능하지 않은 PPMs의 사용을 허용해서는 안 된다는 점에 대해 대체적으로 합의에 도달한 것으로 보인다. 그런데 많은 국가들이 국가별로 채택하고 있는 PPMs에 관한 규범에 대해서는 그 역외적 적용의 효과나 목적과 관련하여 의문이 제기되기도 한다. 이 논문은 각 국가가 취하는 규제조치가 가트 제20조가 규정하는 필요성을 중심으로 하는 정당성의 문제, 영토 내지는 관할권과의 관련성의 문제, 그리고 국제규점에 대한 국제사회의 인식과 지지의 문제 등에 관해서 검토한 것이다.

An ceaseless debate persists as to the connection trade has with the idea of development where the very aims of international trade are questioned in terms of an applicable universal notion. This contribution considered that states as parties to a free trade regime may utilize the grounds of justification to successfully defend attempts to limit externalities. The considerations of extraterritoriality in law of justification proved more complex. The tests may set some limitations to permitted measures for dealing with externalities. The choice of process and production methods will be crucial for the environmental impact of the activity. This article has taken a closer consideration about the jurisdictional limitation of Article XX GATT. The nature of environmental concerns makes case-by-case study important. Rules and restrictions on PPMs adopted by states raise questions related to the extraterritorial effects and objectives of these rules. The intention here is to illustrate how tests of extraterritoriality are taking shape in trade law. But It looks like that the question of whose or which externalities are given relevance may need to be determined by other principles or perceptions of fairness.
