대상판결의 판시취지는, 항소의 일부 취하는 항소 자체의 취하의 효력, 즉 취하된 부분에 대한 항소제기의 효력이 소급하여 소멸하는 효력은 없다. 따라서 병합된 수개의 청구 전부에 대하여 불복한 항소에서 그중 일부 청구에 대한 불복신청을 철회하였다 하더라도 그것은 단지 불복의 범위를 감축하여 심판의 대상을 변경하는 효과를 가져오는 것에 지나지 아니하고, 항소인이 항소심의 변론종결 시까지 불복의 범위를 다시 확장할 수 있는 이상 항소 그 자체의 효력에 아무런 영향이 없다는 것이다. 위 판시취지는 상소불가분의 원칙을 전제로 하는 것인데, 청구가 동일하거나 청구가 선택적, 예비적으로 병합된 경우에는 학설과 판례가 일치하여 상소불가분의 원칙을 긍정한다. 청구가 단순병합된 경우에도 통설과 판례는 이를 긍정하는데, 부정하는 소수설이 있다. 피상소인은 자신의 상소권이 소멸된 뒤에도 부대상소를 제기할 수 있다는 규정과 상소법원은 원판결 중 불복신청이 없는 부분에 대하여는 결정으로 가집행선고를 할 수 있다는 규정은 원판결 중 당사자가 불복신청을 하지 않았으나 확정되지 않은 부분이 있음을 전제로 한 것임이 분명하고, 무엇보다 판결의 확정 여부는 분명한 것이 바람직할 것이므로, 병합의 유형과 상관없이 청구가 객관적으로 병합된 모든 경우에 상소불가분의 원칙이 적용된다고 하는 것이 간명하다고 본다. 결국 대상판결은 항소의 일부 취하는 효력이 없다는 취지를 처음으로 분명히 판시하였다는 점에 의의가 있고, 그 판시취지에 찬성한다.

Supreme Court Decision 2016Da241249(decided on January 12, 2017) deals with the issue whether partial withdrawal of an appeal is valid or not. The Supreme Court says that partial withdrawal of an appeal is invalid and it has only the effect to abbreviate the extent of appeal. This decision is the first Supreme Court judgment on that issue, and is premised on the principle of appeal impartibility. Common view is that the principle shall also be applied to simple consolidation of claims. Many precedents(such as 66Da711, 92Da14892, 94Da3063, 94Da2979, 94Da4644, 94Da1487, 99Da30312, 2000Da9048, 2009Da35842) are same as common view. Civil Procedure Act article 403 stipulates “an appellee may file an incidental appeal not later than a conclusion of the pleadings, even after the right to appeal has been extinguished.” And the act article 406 says “the court of appeals may, upon motion of the parties, issue by its ruling a provisional execution order concerning the portion of the judgment in the first instance against which no appeal has been made.” Those clauses are premised on the principle of appeal impartibility. I consent to the common view and the above decision pursuant to that view.
