실질적 자유지상주의 분배정의의 주요원칙은 다음 세 가지다. 첫 번째는 실질적 자유의 축차적 최소극대화원칙이다. 두 번째는 자신의 순수한 생산적 노력의 산물에 대한 소유는 정의롭다는 노력소득원칙이다. 세 번째는 각자의 순수한 노력의 산물이 아닌 외적 자산에 대해 모두가 평등한 권리를 가진다는 공유원칙이다. 이 글에서는 첫째, 이 세 원칙 및 이들 간의 관계에 대한 엄밀한 연구에 기초하여, 실질적 자유지상주의 분배정의론을 재구성한다. 이를 통해 무엇보다 이 세 원칙이 서로의 전제가 되거나 서로를 보완함으로써, 실질적 자유지상주의 분배정의론을 논리적으로 일관된 체계로 형성함을 보인다. 둘째, 실질적 자유지상주의 분배정의론에 대한 이러한 재구성을 통해, 판 빠레이스가 실질적 자유지상주의 분배정의론에 대한 연구를 통해 동시에 공유주의 분배정의론을 발전시킴을 보인다. 공유주의 분배정의의 핵심원칙은 공유원칙이다. 그런데 이 공유원칙은 실질적 자유지상주의 분배정의 원칙의 하나이기도 하다. 또한 실질적 자유지상주의 분배정의론의 다른 두 원칙은 이 공유원칙과 함께 일관된 체계를 구성한다. 이 글에서는 공유주의 분배정의의 관점에서 이 세 원칙 및 그들의 관계를 엄밀하게 연구하여, 공유주의 분배정의론의 발전된 유형의 하나로 재구성한다. 셋째, 이러한 재구성에 기초하여 판 빠레이스가 사실상 공유주의 분배정의론을 구현하는 공유사회에 대한 전망을 제시함을 보인다. 그렇지만 그가 무엇보다 공유지에 대한 엄정한 평가와 구획을 결여함으로써, 그의 공유사회, 곧 최적 자본주의가 모순과 난점에 봉착함을 보인 것이다. 또한 미드(J. Meade)의 공유사회모형을 비판적으로 변형한 모형을 그 대안으로 제시한다.

Three principles of the real-libertarian theory of distributive justice are as follows; the leximin principle of real freedom, the principle of income resulting from one`s pure productive efforts and sharing principle, i.e., the equal right of all to external assets which is not the result of one`s pure productive efforts. In relation to these three principles, this paper studies on following further themes. First, based on the rigorous studying on these three principles, the real-libertarian theory of distributive justice is reconstructed as a logically consequent system of these three principles. In this system, these principles function as premise for one another or complement one another. Second, this paper shows that van Parijs also develops a theory of distributive justice for commons through his endeavor to develop the real-libertarian theory of distributive justice. The core principle of the distributive justice for commons is the principle of commoning or sharing. The other two principles of the real-libertarian theory of distributive justice construct a consequent system of distributive justice with the principle of commoning. Connected to this, this paper reconstructs a new form of the theory of distributive justice for commons. Third, based on this reconstruction and the critical study on the optimal capitalism of van Parijs, this paper presents that van Parijs suggests in fact a prospect for a sharing society which realizes the distributive justice for commons. Simultaneously, this paper shows the contradictions and problems of his sharing society, i.e. his optimal capitalism which result from his lack of the clear assesment and distinction of commons. As the alternative perspective for the sharing society of van Parijs, this paper presents the model of sharing society of J. Meade, but in a critically modified form.
