2016년부터 문화영향평가가 본격적으로 실시되고 있다. 문화영향평가는 문자 그대로 문화에 미치는 정책영향에 대한 평가이다. 하지만 관련 법규를 분석해보면 문화영향평가는 무엇이 문화에 미치는 정책영향에 대한 평가인지가 불명확하며, 문화에 미치는 어떠한 정책영향에 대한 평가인지도 불명확하다. ⑴ 문화 관련 정책이 의도한 대로 문화에 긍정적인 정책영향을 미치는지 확인하고 긍정적인 정책영향을 어떻게 최대화할 수 있을지를 살펴보는 평가가 있다면 ⑵ 문화와 관련 없는 정책이 문화에 의도하지 않은 부정적인 정책영향을 미치지는 않는지 확인하고, 만약 그렇다면 부정적 정책영향을 어떻게 최소화할 수 있을지를 검토하는 평가가 있을 수 있다. 긍정적 정책영향의 최대화에 초점을 맞춘 평가와 부정적 정책영향의 최소화에 초점을 맞춘 평가는 평가 대상부터 다르기 때문에 그 제도 설계가 차별화될 필요가 있다. 그런데 문화체육관광부는 제도 설계 단계에서 양자를 구분하지 않고 있고, 그 결과로, 지금까지 실시된 24건의 문화영향평가를 살펴보면, 문화영향평가는 주로 문화 관련 정책이 대상으로 선정되고, 긍정적 정책영향 평가에만 치중되고 있음을 확인할 수 있다. 문화영향평가가 성공적으로 자리매김하기 위해서 긍정적 정책영향에 대한 평가는 문화체육관광부의 가이드라인에 따라 해당 문화 관련 정책의 소관부처가 자체적으로 실시하게 하고, 문화체육관광부는 부정적 정책영향을 어떻게 평가할 것인지에 대하여 더욱더 고민해야 한다. 본 연구는 환경영향평가와의 비교를 통해 부정적 정책영향을 효과적으로 평가하기 위한 제도 설계에 대해 논의해본다.
The cultural impact assessment, which began in earnest in 2016, is literally an assessment of policy impacts on culture. However, the target of evaluation and the focus of evaluation are unclear. The policy impact assessment can be generally divided into an assessment of the intended policy impact and an assessment of the unintended impact of the policy. While the former focuses on maximizing positive policy impacts, the latter focuses on minimizing negative policy impacts. Since the targets of evaluation are different, the institutional design for minimization and the institutional design for maximization can not be the same. However, the Ministry of Culture, Sports and Tourism does not consider this issue. Therefore, current cultural impact assessments only evaluate positive policy impacts of cultural policies on culture. For successful cultural impact assessments, the evaluation of positive policy impacts should be carried out by the ministry in charge of the policy. And the Ministry of Culture, Sports and Tourism should be more concerned about how to evaluate negative policy impacts. This study additionally discusses institutional design to effectively evaluate negative policy impacts through comparison with the environmental impact assessment.
