민법상 상린관계는 인접하고 있는 부동산의 이용을 조절하여 이웃간의 평화로운 공동생활을 목적으로 민법 제215조에서 제244조까지 규정을 두고 있다. 그런데 오늘날은 건축기술의 발전과 토지이용의 고도화로 민법상의 상린관계만으로는 공평한 해결을 얻을 수 없기 때문에 공법적 영역인 건축법까지 확대되고 있다. 그래서 건축법상의 상린관계 내용은 사법적 규율과 완전히 다르다고 할 수가 없고 오히려 사법상 상린관계의 원리나 준칙을 근본원칙으로 밀접한 관계를 가지고 상호작용을 하고 있는데, 차면시설과 이격거리에 대한 민법상의 상린관계와 건축법의 접점에 대한 관계는 법의 흠결관계로 이웃간에 사생활 침해와 법정안정성에 심각한 문제를 발생시키고 있다. 특히 도로에 접한 건축면의 창문 등에는 현행 건축법상으로 차면시설의무에 대한 경계선을 어디를 기준으로 해야 하는지 명확한 규정이 없고 민법의 규정을 가지고(민법제 243조) 건축법상의 허가요건의 기준으로 삼기에는 한계가 있기 때문에 결국 도로에 접한 건축면의 창문 등에는 도로너비의 크기와 관계없이 차면시설을 하지 않아도 되는 문제가 발생하고 있다. 그리고 현행 건축법시행령으로는 다가구 주택 등에 대한 이격거리를 규정하고 있지 않지만 민법상 상린관계의 규정에서는 명확히 존재하고 있어, 건축법상 적법하게 건축한 건물이라도 나중에 이격거리를 준수하지 않은 건축물에 대하여 건물의 철거나 손해배상을 당해야 하는 문제가 발생하고 있으며, 현 상태에서 민법상 이격거리조문을 가지고 건축허가요건으로 적용할 수 있을 것인지 문제가 되고 있다. 따라서 본 연구에서는 민법의 상린관계와 건축법의 접점에 대한 내용 중 특히 중요한 차면시설과 이격거리에 대한 입법론적인 개선방안을 제시하여 이웃 간에 사생활 침해를 방지하고 법정안정성을 기하고자 한다.
The adjoining neighbor relationship in the civil act regulates the use of adjoining real estate to adjust the use of adjacent real estate for the purpose of peaceful co-existence between neighbors, which is regulated in Articles 215~244 of the civil act. Today, however, the adjoining neighbor relationship of the civil act is expanding to the building act, which is a public domain because it cannot obtain a fair solution due to the development of architectural technology and the advancement of land use, So the adjoining neighbor relationship in the building act is not completely different from the judicial regulation. Rather, it performs interaction in a close relation with the principle and the rule of adjoining neighbor relationship. The relationship between the adjoining neighbor relationship and the building act contacts on the civil act has serious problems in privacy violation and statutory stability due to the insufficiency of law on the side-block facility and separation distance. In particular, there is no clear definition on the boundary line of side-block facility obligations about the windows of the building facing the road based on the current building act. As the provisions of the civil act (Article 243 of the civil act) has a limit to set it as the criterion of permission requirements of the building act, there is ceaseless violation and controversy of privacy between neighbors as there is no need of side-blocking facility on windows of the architectural side facing the road regardless of the size of the road width. Furthermore, while the current ordinance of the building act does not stipulate a separation distance for multi-house houses, the civil act clearly defines the adjoining neighbor relationship. Thus, the problem of demolishing buildings or damages for buildings that do not comply with the separation distance arises, and it becomes problematic if the civil act can be applied as a building permit requirement with the separation distance provision in the civil act. Accordingly, this study examined the contents of the contact point of adjoining neighbor relationship in the civil act and the building act. In particular, the study suggests the legislative improvement measures on the important side-blocking facility and separation distance in order to prevent private infringement between neighbors and to contribute legislative stability.
