지난해 발생한 경주 지방의 지진으로 인하여 지진 방재대책에 대한 사회적 관심이 증대되고 있다. 공법학계에서도 지진 관련 재난 법제에 대한 활발한 연구가 이루어지고 있다. 불과 10여년 전까지만 해도 재난 관련 법제는 공법학계에서는 사실상 불모지나 다름없었다고 할 수도 있으나, 최근 학계에서 활발한 연구가 이루어지고 있고, 그 결과 미국, 독일, 일본 등 재난 대비법제 분야의 선진국이라 할 수 있는 국가들의 재난법제에 대한 비교법적 연구도 상당히 축적된 상황이다. 이러한 연구들을 통하여 주요 선진국의 재난 법제에 대한 기본 틀에 대한 내용분석과 우리법제에의 수용방안에 대한 대안 제시 등이 충분히 이루어지고 있다고 생각된다. 본 연구는 종래의 재난 법제에 대한 선행연구들을 기반으로 하여, 선진국 재난 법제의 보다 구체적인 내용을 파악해 보려는 데에 1차적 목적을 두고 있다. 우선적인 연구의 대상으로 재난유형상 지진을, 국가로는 미국을 선택하였다. 다음으로, 미국 지진 대응법제의 실체를 파악하기 위하여 종래 주된 연구대상이 되었던 미국 연방 지진대비 법제가 아닌 실제 주민들의 생활관계에 영향을 미치는 강도가 높을 것으로 예상되는 주 정부의 지진대비 법제를 연구의 대상으로 삼았다. 미국 연방 지진법제와 캘리포니아 주 법제를 살펴본 결과, 우리나라에 대한 시사점으로 세가지를 정리할 수 있다. 첫째 미국은 지진위험 감소를 위한 프로그램을 운영하고 있는데 여기에서 중요한 것은 조기경보체계를 구축하는 것이다. 그리고 주민들에 대한 교육과 훈련이 중요하다. 둘째로는 공사협력체계를 통한 지진 대응 네트워크를 활용하는 것이다. 끝으로, 미국 캘리포니아 주 재난관리국과 같이 지방 단위에서 재난 대응을 총괄할 수 있는 조직을 만들 필요가 있다. 우리나라의 현실에서는 그러한 조직을 지방자치단체에 소속시키는 것보다 특별지방행정기관의 형태로 만드는 것도 고려할 수 있는 대안이 될 수 있을 것이다.
Due to the earthquake occurred in Gyeong-ju last year, interest in earthquake response measures is increasing. There are many remarkable researches on the disaster-legislation related to earthquake in the public law academy. Only about 10 years ago, there were few researches on the disaster response legislation in the public law academy. It has been actively researched recently. As a result, there are many accumulated comparative legal research on the legal system in the disaster preparedness sector of so called an advanced country such as the United States, Germany and Japan. Through these studies, it is thought that the analysis of the basic framework of the disaster response legal system of major countries and the suggestion of alternatives to our legal system are sufficiently achieved. The purpose of this study is to understand more detailed contents of disaster response legislation in advanced countries on the basis of previous studies on that legislation in the past. We selected the disaster type, earthquake, as the primary research target and the United States as the nation. Secondly, to understand the US earthquake response legislation substantively, we selected US state-level legislation system rather than the US federal-level legislation system. The reason is that the former is more expected to have a substantive impact on the life of the actual residents. As a result of research on the US federal earthquake laws and California law, we can summarize three points as implications for our country. First, the United States operates earthquake hazard mitigation program, it is important to establish an early warning system. And education and training for residents is important, too. The second is to facilitate earthquake response network through the public-private partnership. Finally, it is necessary to create an organization that can oversee disaster response at the local level, such as the California Office of Emergency Service. In Korea, it would be an alternative to consider such an organization as a special local administrative agency rather than administration instituted in local government.
