본 논문은 현재 디자인권의 `디자인 정의`가 그래픽디자인의 `디자인 정의`를 포괄하지 못하여 괴리가 있다고 판단하였으며, 디자인 전공자의 관점으로 디자인보호법에 의견을 제시할 방안을 모색하고자 하였다. 따라서 문헌과 판례 연구를 통해 실질적인 그래픽 디자인과 재판적용상의 디자인 정의에 대한 차이를 살피고 고려되어야 하는 요소들을 도출하는 것을 목적으로 한다. 이를 위하여 먼저 그래픽디자인의 정의를 구성하는 요소는 지난 5년간의 그래픽 디자인 관련 문헌을 대상으로 질적연구의 부호화 방법으로 도출 하였다. 총 7개의 요소로, 내용분석에 이용할 그래픽디자인 정의 요소 프레임에 적용하였다. 내용 분석의 대상은 2차원 그래픽디자인과 관련된 총 34건 판결을 활용하였다. 마지막으로 전문가 인터뷰를 통하여 연구의 내용과 분석 결과에 대한 의견을 들었다. 본 연구를 통해 디자인권의 `디자인 정의`는 그래픽디자인의 ``기능성`과 `전문성`을 포괄하지 못하고 있다는 것을 알 수 있었다. 즉 그래픽디자인은 적용된 물품에 기능이 한정되지 않으며 그 자체로 정보를 전달하고 표현하는 기능을 수행하고 보호받아야 한다는 인식과 독립된 하나의 디자인 전문 분야라는 것에 대한 인식제고가 필요한 것으로 보인다.

In this study, it is determined that the `design definition` of the design field does not include the design definition of graphic design. From a design specialist`s perspective, it seeks ways to add opinions to the Design Protection Act. Through the research on literature studies and precedents, the goal of this study is drawing a conclusion of the difference between actual graphic design and `design definition` in terms of application at a trial, as well as proposing what elements need to be considered. Firstly, to do so, elements that compose of the definition of graphic design are reasoned out through the coding for qualitative research on the last five years of graphic design related literatures. Seven elements in total are applied to the frame that defines graphic design is structured. The subject of content analysis is 34 cases related to two dimensional graphic design. Lastly, interviews that deal with experts` views on the content of the study and the outcome of analysis is conducted. Through the analysis of this study, it is found that the `design definition`` of the design field does not include `functionality` and `professionality.` In other words, the following awareness needs to be raised: (1) graphic design is not limited to products by which it is applied, and (2) it is one independent professional filed of design.
