환경침해의 위법성판단에서 수인한도론과 관련하여 일본에서 주장된 것이 위법 성단계설(위법성 2원론)인데, 환경침해에 대한 유지청구권이 인정되기 위해서는 손해배상청구권이 인정되는 경우보다 높은 위법성을 요건으로 한다는 것이다. 이러한 위법성단계설이 주장되는 이유는, 유지청구는 손해배상에 비해 기업에 치명적인 타격을 주며, 소송의 태양도 위법성판단에 요인이 될 수 있으므로 양자의 위법성에 차이가 인정될 수 있다고 한다. 일본의 판례는 도로의 공공성 등을 이유로 위법성단계설을 받아들여, 동일한 환경침해 사건에서 손해배상청구는 인용하고 유지청구는 기각을 하였다.
위법성단계설에 대한 우리나라에서의 논의를 보면, 이를 긍정하는 견해와 동일한 행위의 위법성이 구제방법에 따라 달리 평가되는 것은 타당하지 않다고 하면서 이를 부정하는 견해, 그리고 우리 민법 제217조와 관련하여 판단하면 족하고 위법 성단계설을 취할 필요가 없다는 견해가 있다. 위법성단계설에 대하여 대법원은 그간 판단한 바가 없었지만, 이 사건에서 대법원은 고속도로소음에 대한 피해자의 유지청구의 경우, 고속도로의 공공성 등을 이유로 손해배상청구와는 달리 수인한도의 초과여부를 보다 엄격히 판단해야 한다고 하여서, 위법성단계설을 최초로 인정하였다.
그러나 독일민법 제906조를 계수한 우리 민법 제217조 제2항에 의하면, 가해 `토지의 통상적 용도`에 적당한 환경침해에 대해서 피해자는 인용의무가 있다고 명시적으로 규정하고 있다. 그러므로 이 사건은 위법성단계설을 취하지 않고서도 고속도로소음이 `토지의 통상적 용도`에 적당하였는지 여부의 판단으로 해결할 수 있는 문제라고 할 것이다. 비교법적으로도 독일 판례는 고속도로소음 등에 대해 서 독일민법 제906조상의 가해토지의 장소통상적 이용으로 인한 침해로 보아 피해자들의 인용의무를 인정하고 있다.
As regards the theory of endurance limit, a factor in determining illegality in an environmental infringement, Japan theorized about the illegality stage. According to the theory, an injunction against an environmental infringement may be accepted when the illegality of environmental infringement is regarded as more serious than cases where a claim for damages is accepted. The theory of illegality stage is propounded for the following reasons: as compared to a claim for damages, an injunction can be a deathblow to a company, and the form of action can be a factor in determining illegality, and thus the difference in illegality between two can be acknowledged. Referring to a precedent of Japan, the theory of illegality stage was accepted for reason of the publicness of a road, and the result was that a claim for damages was accepted but an injunction was dismissed despite the same case of environmental infringement.
In South Korea, there are contrasting views regarding the theory of illegality stage; contrary to a positive view, a negative view points out that the determination of illegality can be different according to the remedy, notwithstanding the same action. An additional view is that Article 217 of Civil Code can be applied to such problems, and that there is no need to take the theory of illegality stage. With regard to this case, i.e., an injunction against highway noise, the Supreme Court emphasized a strict determination of whether it exceeds the endurance limit, unlike a claim for damages; specifically, it is the first time the Supreme Court accepted the theory of illegality stage.
Clause 2 of Article 217 in Korea`s Civil Code originated from Article 906 of Germany`s Civil Code, however, stipulates that the victim has the duty of patience in cases where an environmental infringement is within the `conventional use of land.` Therefore, this case can be solved by determination of whether the highway noise is within the conventional use of land, without applying the theory of illegality stage. Likewise, in terms of comparison, Article 906 of Germany`s Civil Code regards highway noises as an infringement within the locationally conventional use of land and thus that the victim has the duty of patience.
