민주주의에 대해서 부정적이고 의심스러운 눈빛을 보내는 자유주의입장에서 민주주의는 헌법이라는 제도적 장치를 통해서 부단히 제약되어야 하는 대상이다. 다수의 지배로서 표면화되는 민주주의 하에서 자유주의적 입헌민주주의체제는 평등한 시민권-시민적·정치적 권리와 사회적·경제적 권리-이라는 실질적 가치를 추구한다. 특히, 자유주의적 입헌민주주의체제는 ‘소수자에 대한 평등의 배려와 관심’을 헌법적 가치의 주된 지향점으로 제시하고 있다. 이런 점에서 자유주의적 입헌민주주의체제는 법과 정치의 이원적 대립구도를 통해서 경쟁적이고 혹은 적대적인 다원화된 정치적 공간을 ‘다원주의의 평화로운 공존’으로 전환하려고 노력한다. 하지만 민주주의를 다수의 지배로 규정하고 법에 의한 민주주의의 제약의 필요성을 역설하는 자유주의입장은 근본적으로 헌법의 정당성문제에 대한 내적 딜레마에 봉착해 있다. 특히, 이 문제는 기본권목록구성과 관련된 기본권 정당화 방식에 있어서 한계점을 드러낸다. 자유주의자들이 주장하는 기본권 목록구성과 관련된 기본권 정당화에 대한 전통적인 방식인 자연법적 전통은 다원주의라는 정치적 사실에 비추어 볼 때 현대인들에게 합당하게 수용될 수 없다. 또한 자유주의적 입헌민주주의는 기본권 정당화에 대한 합의적 방식을 취할 수도 없다. 자유주의전통이 가지는 하나의 공리인 통약불가능성을 고려할 때, 합의적 방식은 자유주의자 자신들이 배제했던 방식인 다수결원칙과 연결될 수밖에 없다.

In this point that liberalists understand democracy as negative political system, liberal constitutional democracy attempts to constrain democracy through constitution. Under democracy that is exposed as majority rule, liberal constitutional democracy pursuits the practical value such as citizenship·political rights and social·economic rights. Specially, Through judicial review(or constitutional court) liberal constitutional democracy presents equal interest and care for minorities as constitutional value orientation. In this point, liberal constitutional democracy endeavors to change competitive or hostile political sphere into the peaceful coexistence of pluralism. But Liberalism that considers democracy as majority rule and that states the need for the constraint of democracy by law basically is faced with the internal diliemma for constitutional legitimacy. In other words liberal constitutional democracy has obvious limits in basic human rights formation. Natural law tradition that has been traditionally used for constitutional legitimacy is not admitted under political pluralism. On the other hand, consensual method can not be selected too. When we consider incommensurability working as a axiom of liberalists, consensual method is connected to majority rule that liberalists have excluded.
