합리적 감정에 기초한 법적 정의에 대한 연구

이 글은 현대인지과학과 법 사이의 학제적 연구 중 ‘감정과 법’의 관계에 초점을 두었다. 최근의 감정에 대한 연구들은 감정 또한 이성과 마찬가지로 인지적(cognitive) 성격을 가진다는 주장이 쏟아지고 있다. “감정이 인지하고 판단한다”는 것은 ‘감정의 합리성’을 의미한다. 이 글은 대략 세 부분으로 이루어져 있다. 첫째 감정을 신체적 느낌으로 보는 비인지적 감정론과 신체적 느낌이 아닌 지향성(intentionality)을 가진 인지적 감정론을 위주로 종래 심리학과 철학에서 논의되고 있는 이론들을 소개한다. 필자는 인지적 감정에 대한 논의들이 믿음에 대한 명제적 판단, 객관성, 비일관성, 인과관계 등 합리성에 의존하고 있는 전통철학의 논의와 별반 다르지 않는 지점들을 고찰하였다. 감정의 합리성이라는 질문이 바로 감정이라는 신체적 자연종이 아니라 비자연종에 대한 것으로 구성하려는 이론들을 보았다. 필자는 인지적 감정론의 의미를 감정의 규범성에서 찾고자 하였다. 연민과 신체적 기능으로서의 감정이입(empathy)등을 고려할 때, 이성 중심의 법규범이 보지 못한 보편성을 제시할 여지를 인지적 감정론이 보여주고 있다. 연민이나 감정이입과 같은 감정의 형태들은 기존의 법적 정의의 원리에 전적으로 편입되지 못하였던 요소들이다. 만일 이러한 요소들을 법적 정의의 관점에서 고려한다면, 그것은 올바름을 향한 진리추구의 영역이 아니라 인간다운 삶의 진정성(authenticity)을 추구하는 ‘사랑의 원리’에서 그 의미가 찾아진다. 두 번째는 지향성(intentionality)개념을 통해 인간의 마음을 설명하는 이론들은 감정의 합리성에 대한 새로운 논의를 제시한다. 이는 여전히 이성중심의 철학적 논의 행태와 비슷하기 때문에 감정이 이성과 같이 자연종이 아니라는 비판에 직면하기도 한다. 이러한 비판에 동감하는 필자는 벤제에프(A. BEN-ZE’EV)의 주장을 검토한다. 그에 따르면 감정은 이성과 같은 숙고적 메카니즘이 아니라 “적절한 반응(an appropriate response)”이다. 감정은 최적의 반응이라는 점에서 책임을 발생시킨다. 지성이 지적인 계산(intellectual calculation)을 기술적(descriptive) 합리성의 측면에서 요청한다면 감정은 규범적 합리성이라는 측면에서 최적의(optimal) 반응을 요청한다. 그런 점에서 벤제에프에 따르면 감정은 민감성(sensibility)이다. 감정의 합리성은 이성적 지적 논증방식이 아니라 민감성이라는 종합적인 논증방식을 가진다. 필자는 복잡한 정보의 과정과 반응으로서 감정을 분석한 후에 드 수자(Ronald de Sousa)의 견해를 검토한다. 드 수자는 감정의 합리성이라는 토대를 이성적 진리가 아니라, ‘감정적 진리’라는 측면에서 재구성한다. 셋째는 감정의 합리성은 법철학적 논의에서 어떤 의미를 가지는가를 묻는다. 필자는 감정은 법체계 전체를 움직이는 중심에 있는 요소라고 주장하였다. 법감정은 일종의 연대의 감정이다. 명령과 강제, 의무와 책임의 법제도가 엄연히 인간의 감정에 대한 제한임에도 연대의 감정을 위한 법개념적 고려는 논의되지 않았다. 법과 감정의 연관성은 형법과 불법행위법에서 법의 외적 정당화로서 국부적으로만 사용되어져 왔다. 그러나 오늘날 법과 감정의 연관성은 사회구석구석에 모두 필요한 논제가 되었다. 땅콩회항사건, 세월호 사건에서 보여준 대통령의 태도, 동성애문제, 갑질 논란 등 모든 사회문제들이 법적으로 비화되는 배경에는 인간의 감정에 대한 손상이 불법의 문턱까지 이르렀다. 필자는 이 글을 통해 궁극적으로 ‘비감정적 법적 테제’가 법제도 전반에 유지될 수 없다는 주장의 단초를 마련하고자 한다. 법형식주의, 법현실주의, 법실증주의, 그리고 자연법론에서감정은 법제도나 법을 운용하는 사람들 모두에서 편협함을 보여주고 있다. 법과 감정의 연관성은 마치 정의를 훼손하는 것처럼 묵시적으로 가려져 있다. 법은 감정이 없이는 어떠한 판단도 불가능하다. 법을 감정적 밴드로 보려는 인지적 감정론은 감정이 법 전체에 내재되어 있는 지점을 폭로한다. 필자는 이 글에서 법감정에 대한 법인지주의 이론을 본격적으로 고찰하기 이전단계로서 학제적 연구를 수행했다. [감정 안에 있는 이성]을 보기 위해 솔로몬과 누스바움의 연민의 감정론까지 ‘공감적 감정’의 법적 유입 지점을 타진한해 보았다. 특히 공적인 정서적 경험에 바탕한 연민이나 배려는 ‘사랑’의 이념에서 나오는 감정이다. 정의의 원리는 사랑의 원리가 없으면 실현될 수 없다. 법을 감정을 통해 설명한다는 것은 존재론적인 모험이다. 법적 규범성이 감정의 진실성을 향해 있다는 존재론적인 구성 자체가 애매하고 위험하다는 비판을 이 글 역시 감내해야 할 것이다.

This article focuses on the relationship between emotion and law in interdisciplinary research between modern cognitive science and law. Studies on recent emotions have been argued that emotions are cognitive as well as reasonable and rational. The discussion of ‘rationality of emotion’ is one example. “Emotions recognize, perceive and judge” means ‘the rationality of emotion’ I hope that this article will ultimately provide a basis for the assertion that the ‘non-emotional legal these’ can not be maintained throughout the legal system. In legal formalism, legal realism, legal positivism, and natural law, emotions show insularity in both legal system and lawyers. The link between law and emotion is implicitly masked as if it undermines justice. Law can not make any judgment without emotion. The cognitive emotion theory that sees the law as an emotional solidarity and bond exposes the point where emotion is embedded in the whole law. Before introducing the theory on the relationship of law and emotion, I would like to see the point where makes it legal, the point of ‘compassion based on empathy’ through the emotion theory of Solomon and Nussbaum as an interdisciplinary study [emotion is judgment]. Especially, I try to look at the normativity of emotion in the principle of ‘love’ as well as the idea of justice in compassion and concern based on public affective experience. The principle of love is an adventurous attempt of emotional ontology as ‘a reciprocity these’. This article is roughly divided into three parts. First, I introduce on the non-cognitive emotion theory which sees the emotion as bodily feeling and the cognitive emotion theory which regards the emotion as intentionality. I have examined the viewpoints of cognitive emotions that are not different from those of reason-centered philosophy, which relies on rationality such as right judgment, objectivity, inconsistency, causal relation to faith. I try to read the meaning of cognitive emotion from the normativity of emotion. Cognitive emotion theory shows the possibility of universality that was not seen by reason-centered legal sysytem when considering public emotions such as compassion and concern. The forms of emotions, such as compassion based empathy, are elements that were not fully incorporated into the existing principles of legal justice. If we could read these factors from the point of view of legal justice, it is found in the principle of love that seeks the authenticity of human life, not the realm of truth seeking towards righteousness. Second, according to AARON BEN-ZE'EV’s, the logic of emotion is explained into ‘sensibility’ as a ‘appropriate response’. It shows the rationality of emotion in normative sense. He claims that emotional reality has a different logical structure from intellectual reality. According to him, the rationality of emotion is found into the ‘optimal response’. Also I, following De Sousa’s, the rationality of emotions accept his 'emotional truth' critically. Third, I ask what the emotional rationality means in the legal philosophy. The relationship between law and emotions in jurisprudence should not have been raised and discussed positively. Traditionally, legal positivism has not treated the emotional normativity as the important. Emotional truth would be achieved when we could recognize and responses emotion at the core of the event appropriately. Although the legal system of command and enforcement, duty and responsibility puts a limitation on human emotions, the legal consideration for the emotion of solidarity has not been obviously discussed. The link between law and emotion has only been used locally as external justification of law in criminal law and tort law. But the link between law and emotion has become a necessary issue in every cornerstone of society. Because the damage to human emotions reaches to the threshold of illegality and injustice in many social problems. Explaining laws through emotions is an ontological adventure. This article should also endure criticism that the ontological constructivism about emotions itself is vague and dangerous, where legal normativity is directed toward the truth of emotion.
