우리 헌법 제32조 제3항은 근로조건의 기준은 인간의 존엄성을 보장하도록 법률로 정하도록 규정하고 있고, 근로기준법을 통해 임금, 근로시간과 휴식 등에 관하여 법적 기준을 마련하고 있다. 그렇지만 우리나라 노동시간이 매우 길다는 것은 어제 오늘의 일이 아니고, 최근 들어서는 여러 직업의 종사자들이 과로로 인해 생을 마감하는 안타까운 일이 연이어 벌어졌다. 이는 결국 법과 계약을 통해 형성되는 근로조건의 형성에 문제가 있다고 볼 수밖에 없다. 생명을 잃을 정도로 과로한다는 것은 업무로부터 완전히 분리된 상태에 있지 못한 채 제대로 쉬지 못한다는 의미이고 이것은 근로자들이 자유롭지 못하다는 것을 뜻한다. 그렇다면 어떤 상태가 되어야 근로자가 자유롭다고 할 수 있을지를 판단하기 위해 자유의 개념을 생각해 볼 필요가 있다. 근로자가 자유롭지 못하다면 근로조건을 포함하여 근로자 본인에게 영향을 미칠 회사의 결정에 관하여 의견을 제시하는 것이 회사의 구성원으로서 가능해야 할 것이다. 이는 결국 직장에서 민주주의가 적용될 수 있는가의 문제가 될 것이다. 한편 회사가 근로자에게 가혹한 업무를 부담시키는 이유는 근로자에게 지급되는 임금을 비용으로 보기 때문이다. 비용을 줄여야 이익이 높아지므로 비용으로 인식되는 임금을 줄이려는 것이다. 이는 근로자를 바라보는 관점에서 비롯되는 것이므로 회사에서 근로자를 어떻게 바라보아야 할지 생각해 볼 필요가 있다.

Article 32 (3) of the Constitution of the Republic of Korea stipulates that the standard of working conditions shall be set by law to ensure the dignity of human beings. And the Labor Standards Act provides legal standards for wages, working hours and rests. However, the working time in Korea is very long. Recently, there have been many infelicitous incidents that many workers have been passed away due to overwork. This means that there is a problem in the formation of working conditions that are formed through laws and contracts. Workers are overworked to lose their lives. It means that workers can not rest properly when separated from work. If so, we need to think about the concept of freedom in order to judge that a worker could be free in what condition. Then, if the worker is not free, it should be possible for the company to be able to comment on the decision of the company to affect the employee, including working conditions. This will ultimately be a question of whether democracy can be applied at work. On the other hand, because companies think that it is profitable to give less work wages to workers, the company makes workers work harder to reduce wages. This comes from the viewpoint of the workers and wages, so it is necessary to think about how the company should look at the workers and wages.
