아동학대의 심각성으로 인해 우리 사회에서는 아동학대피해의 예방, 학대피해아동의 보호, 학대피해아동의 권리에 대한 관심이 증폭되고 있다. 2013년 아동학대 사망사건이 발생하면서 학대행위자에 대한 강력한 처벌을 통해 아동학대를 예방하고, 학대피해아동의 보호를 강화하기 위해 아동학대 관련 법률 등이 제·개정 시행되고 있다. 하지만 국가차원에서는 학대피해아동의 보호를 위해 회복과 지원을 위한 다양한 노력들을 하고 있지만 여전히 미흡한 실정이다. 「아동학대범죄의 처벌 등에 관한 특례법」의 제정 이후 아동학대 현장에서의 아동학대 방지와 행위자에 대한 처벌은 강화되었지만 학대피해아동의 보호와 지원을 위해서는 재원과 전문성의 부족으로 효과성이 크지 않은 실정이다. 이에 본 연구에서는 현행 학대피해아동에 대한 보호, 지원을 위한 아동학대범죄처벌법 체계의 실태와 문제점을 고찰하고 효과적인 방안을 강구해 보고자하며, 다음과 같은 개선방안을 제시하였다. 첫째, 학대피해아동의 보호, 지원에 관한 문제점을 파악하고 지역사회기관과 응급처치협력방안을 제시하였고, 둘째, 아동보호전문기관의 유기적인 협조체제를 구축하기 위해 학대피해아동의 긴급임시조치명문화를 제시함으로써 학대피해아동의 보호와 지원에 있어서 효율적 활용을 도모할 수 있는 방안을 제시하고 한다. 셋째, 임시조치담당기관 ‘(가칭)피해아동지역협의회 설립, 피해아동보호명령의 구체적인 대응방안 매뉴얼 제정, 국선변호사의 활성화를 제시하였다.

Today, child abuse is a serious problem all over the world. Diverse organ has been involved in a campaign against child abuse. The most obvious reason that child abuse is still prevalent in Korean society is that physical punishment has been socially accepted as a means of discipline for decades. Child abuse spans across the class system and across the education system. We don't know whether these children are still being the victims of child abuse. Child abuse Mothers and fathers are the most prevalent perpetrators; They represent approximately 70% of all cases. Its long term effect is beyond our comprehension. Child abuse endangers life and health. Child abuse is on a steady rise in the Korea. Lately, child abuse has become a major social problem in Korea. Child abuse can be defined in many different ways. There are many ways in which one can prevent child abuse. I guess child abuse law would be a precedence. Proper training by child psychologists should be given to social workers dealing with abused children. Child abuse must be forbidden. Ultimately, these procedures will help decrease the chronic practice of child abuse in Korea.
