세조대 사방지는 이순지 딸과 간통사건을 일으켰지만, 여자 옷을 입고 생활하던 정황과 그에 대한 양성인 논란이 가중되면서 간통죄로 치죄되지 않고 그야말로 스캔들로 다루어진 독특한 사건이다. 본고는 사방지 스캔들이 성의 권력적인 속성을 여실히 보여주면서 세조대 힘에 의한 국정 운영 방식을 흥미롭게 증명해준다는 데에 주목하여, 간통녀인 이순지 딸의 위상과 행위를 중심으로 이 사건을 재구하면서 초법적 권력이 작동되는 과정과 여성의 욕망이 배제되는 방식을 살펴보았다. 이순지의 딸이자 정인지의 사돈이었던 이씨는 친인척 관계를 동원하여 간통 사건을 초법적으로 해결하고 사방지를 되찾고자 했는데, 여장과 간통이라는 사방지의 범죄가 형법을 비껴갈 수 있었던 것은 여장문제에서 사방지를 철저히 타자화하고, 그의 신체를 양성인으로 더하여 비인류로 규정함으로써 가능했다. 이렇게 하여 ‘정상적’으로 행동하지 않는 남성들을 진정한 남성에서 배제하며 가부장 사회의 남성성과 성의 질서를 지킬 수 있게 되었고, 그를 둘러싼 여인들의 행위는 성적으로 보이는 물건에 집착한 집단적인 페티시 현상으로 치부되기에 이르렀다. 15세기 사방지 스캔들에서 보인 여성들의 적극적인 욕망표출 양상은 남성 중심 지배질서에 경각심을 불러일으켰고, 이를 질서화하는 과정에서 능동적이고 과감하게 욕망하던 성적 주체로서의 여성들은 사라지게 되었다.

SaBangJi who was the salve committed adultery with a widow who was noble woman called Madam Lee. In Joseon Dynasty, adultery between a novel woman and a slave suffered the capital punishment, but in case of SaBangJi, the Royal Court discussed ways to decide his sex and to interpret the meaning of his sexual behaviour, because he had dressed up as a woman. In this thesis I studied the sexual politics of SaBangJi scandal. He was avoided punishment by the King Sejo’s favor, that probably caused by adulterer Madam Lee’s lobby. Through the process of re-establish the value of morality after this scandal, I also investigated how the women’s desire had been excluded. in Joseon, cross-dresser and adultery were serious crime on no condition. But the King Sejo made the SaBangJi’s body as the other, then judged as a true hermaphrodite, finally defined he is not human-being. It is to maintain the patriarchal order by removing the man whose behavior dose not seem like a ‘real man’. SaBangJi was determined not human being, so the women’s behavior towards him must be interpreted as a fetish about sexual thing. In 15th century, we can find women who expressed her sexual desire actively through SaBangJi scandal. It should arouse male overlord’s attention to strengthen sexual norm for the patriarchal rule in Joseon Dynasty.
